I work in an ortho practice that treats a lot of WC patients and I've always wondered about the insurance side of these cases. They flood our office with requests for medical records, functional capacity questionnaires etc and it's maddening. Some of our patients have been severely injured yet somehow the insurance company can convince a judge that patient can be up roofing homes even though our patient is nearly bedridden from pain. There has to be a better way to treat injured workers.

A lot of the things he is saying insurance companies don’t need they do to prevent and deter injury fraud which attorneys gladly help embellish because it obviously effects their pay day at the end so they have an incentive. It goes both ways though there is bad people in insurance and a lot of attorneys in the same boat.

I've been researching WC Laws/Administrative for the past year and this is the first Real Lawyer who's telling the truth. Most of these WC Lawyers actually really works for the everyone other than the actual injured worker. "a medical examiner agreed to by them?" something is wrong with that picture. I'm on a case now and I wish you were in CA

Omg you are right .. they did that to me . I got everything denied. Than the doctor they had me see told them that my injury was no work related.

Gotta love how the math is ALREADY in their favor, but being a glorified casino isn't good enough, so they want to CHEAT even more. Even casinos aren't allowed to refuse to pay out.

Got to an accident truck slammed into me while I was at work I need 2 surgeries then they sent me to a IME they said I’m good to go back to work so here I am not getting paid while I’m waiting for surgery Workmen’s Compensation insurance is a evil organization

I was hurt, torn rotator cuff and bicep, in Iraq working a bomb dog as a civilian contractor for SOC LLC. SOC and their insurance company, Broadspire fought and denied my claim for 7 months. SOC LLC fired me on December 8, 2020 and my DBA claim was approved on December 9, 2020. Broadspire's attorney even threatened my attorney after the claim was approved by saying, "if we do not drop the LS-18, we will cut off Kurt's disability benefits" which was the weekly monetary benefit.

Hey Brian, thanks for sharing your experience on worker's compensation claims. I work for a doctor here in NY and we are concerned about the MG2 that the payers deny often when we request for more therapy visits. However, there are many providers here in the same area who have been treating the patients for an injury which is older than 10 to 15 years.

Could you help me understand what are causing them deny MG2 more frequently when patients really need continuation of therapy?

How can we win against them in such scenarios?

That's exactly what is happening to me, I have a ruptured tendon and need surgery, senior resolution manager stopped my payments and said she needed an updated Dr's note and she got two. And I had to take myself to the Dr. I told my assistant manager and he said, just go home. I said no I need medical attention and he said tell the manager on Monday, but after I got off of work and told Human Resources and the owner was there, I told them about it and they just looked at me like we're have a conversation. They didn't ask about if I was taken to seek medical treatment and now Gallagher Bassett and my so called employer are playing kid games.... I'm beyond pissed

Thank you the advise helps im going into deposition I never been paid a cent for 6 months and been out. They threatened me and their lawyers left the deposition paper in my mail box instead of serving me. They had their own medical guy who did say something is wrong with my leg. They would send me stuff and not my lawyer. The companies tried to give me a deposition without my attorney's knowledge
