he “often” goes for drives late at night? Then police will have footage/pings of these drives weeks before and after crimes.

"Mr. Kohberger is prepared to provide further detail in an ex parte’ hearing with the court." This sounds like the defense's version of a grand jury. Only Mr. Kohberger, the defense attorneys, and the judge. I would love to see this take place.

The thing is, he _was_ driving around in his car that night. We can see in the PCA that he drove around and around that neighborhood 3 or 4 times. There’s a big loop that he kept driving around King Rd before he finally did the 3-point turn and then parked by the house. And then he took that circuitous rout home.

So this “alibi” is kind of useless imo. Both can be true. He could have been driving around that night by himself _and_ went in the house for 20 minutes and murdered the 4 students like the state says happened.

This alibi and the state’s theory are not mutually exclusive. But a real alibi should be. “I was here so I _couldn’t have been_ there.” Unless they’re going to prove that he was driving somewhere else, nowhere near the King Rd house this alibi doesn’t help him.

I ran recovery/tow truck all around that area. You don't need to turn off phone if outside Moscow. Cell towers are extremely spotty aka mountains/valleys. I personally ran a 2nd phone (sprint) just for that area, the spotty towers have different carriers. There are dead spots along the main Hwy to boot. Can't drive main roads long without popping a tower. Sure can hit up back roads, lake/river/scenic area. Zero cell. Made a good living 7 day work weeks, fetching peeps/vehicles out and about for a drive. If headed east of Moscow, counted on no cell

This is why it's wise to remain silent. The state has traffic camera and security camera footage of him leaving Pullman, and returning to his apartment. The problem is this; can the defense provide camera footage of Kohberger somewhere else either at the time of the murders, or far enough away that there was no way he could have arrived in time.

Thank you Peter for continuing to cover this case and explain all of these court documents to those of us without a legal background. I have learned so much about the legal process here in the States from your videos. Perhaps it is because of the gag orders, but there is so much about the case against BK as well as what information the defense has that the public isn’t aware of and we won’t be made aware of until this case goes to trial.

What I’m hearing with this statement is “we haven’t produced an alibi b/c he doesn’t have one [that can be corroborated].

And “we’re not cooperating b/c the state chose a secret grand jury over a preliminary hearing.”

I had a feeling that’s where this was headed! A couple reasons:
1. They were being really wishy-washy about this whole alibi thing, clearly buying themselves time (IMO)
2. Up until now, they had made such a huge fuss about the Elantra in their other motions- questioning the credibility and training of the officers who identified it, discrepancy in the year, etc.

I completely agree with you that they have at this point exhausted every potential way to poke a hole in the prosecution’s ability to place BK in the car at those specific times. They are conceding the ability to argue it wasn’t him driving, it wasn’t his car, he wasn’t in the car, etc. I think they have been going over all of those options tirelessly as they delayed producing an alibi.

When confronted with the fact that they have to concede it was him in the car at those times, that they couldn’t question any of that, the only option would be to make that work for them. Hence, the state proves it was him driving the car at those times, and the defense says “the state has just proved he drives around in his car at night. There he is, in his car, driving around, and look how often he does this! Clearly its a habit!”

But I think this was not Plan B, not Plan C, but Plan Z - worst case scenario, admit that’s him in the car and use it as an alibi. My response to that is Rut Row!!!

Also, I don’t know if you happened to catch any of Melly’s hearing today, but a friend of ours made a cameo appearance! Here’s a hint: his first name is Mark and his last name rhymes with “Smeiglarsh”

It leads me to think he is trying to explain the phone pings previously as well. Interesting that his night driving route leads him so close to the King road house!

It seems like he is using his knowledge of the law to play the system. I hope it doesn't end up being another situation like the Brice Rhodes case.
