Even if i have to deposit some money. That's why you never deposit with cash. I always use credit cards for my deposit. This happened to me I called Amex and got my money back.

I have a simple recommendation for how they can get their deposit back. Simply fill out a small claims action and name the sales manager and take him to court on a Monday morning they will settle.

Many decades ago, one Saturday morning, my father got a phone call from my brother-in-law, who explained that he had been talked into signing over his payroll check to a car dealer the previous evening. When he decided not to make a deal, they refused to giving his check back, telling him it was locked up in the company safe and would unavailable until Monday. My father and I drove to the dealership. When we arrived, my father found the sales manager and asked him to return the check to my brother-in-law. When the manage told him the same story about not returning the check, my father went out to the sales floor, which was crowded with customers. In a loud voice, he began to describe how the dealership was run by crooks and refused to return a deposit. Within a minute or two, the manager appeared with the check. Moral of the story: speak up—in a loud voice!

If i put a deposit down i would do it with a credit card and if the dealership refuses to refund ill dispute the charge. I’ve done it before and got my money back.

The purpose of the deposit is to protect the dealer from lack of performance by the buyer. In this case the lack of performance was on the part of the seller (dealer). Refundable or non refundable makes no difference. The dealer did not perform so they cannot keep the deposit.

I walked away from a dealership due to the non-refundable deposit. It just helped me go from maybe I will get the truck to I can wait longer.

My short story is: 2 ford dealerships, tried purchasing a 2014 Ford Fusion, the original appointment was change to a different salesman I was speaking with, the new guy was rushy and pushy as it could be, I told the guy I would not sign the purchase without sitting on the offer overnight, I needed a day to think about it just to avoid impulse purchase and to let the opportunity sink in. They tried and tried several times, when we found a good deal on my trade in they drafted the purchase and to my surprised "they fooled me into signing a more expensive deal" I called them out and they said it was an honest mistake. I walked away and they took a whole week to refund my deposit. Second dealer where I did bought a vehicle tried changing the sale price 500 bucks up at the last minute, I had screenshots of the listing and they were surprised I had the old info, they tried saving face saying"they would honour the original price" when they tried getting 500 more out of me, , they also promised a full tank of gas and the car had half, , , I demanded the tank of gas. UNTIL the very last minute read EVERYTHING question the numbers and payments, trade in values and all.

Dealership keeps customer 's deposit is really shortsighted. If I was the customer, I would have blasted the dealership via all the social media to not buy the car from that particular dealership. I am sure at the end of it, dealership would lose more potential customers than it think just to keep that lousy $500.

A deposit is an agreement/contract. If the dealer failed to meet their end of the specifics outlined in the agreement, the "non-refundable" deposit is moot. It's Non-refundable only if the dealer meets it's obligation, or still has the opportunity to do so. If the language leaves the dealers obligation very wide and open ended then it's tough to fight.

It's very basic case law.

Does this dealership really need some hard working person’s $500? Wow. Yes, we need to look out but really?? The dealership also said a few weeks then changed the timeline. Do I really need to bring a lawyer with me to buy a car these days?
