A contract with wet ink signature and full disclosure are extremely important. A COPY will not suffice.

In fighting any case, you have to cite rules, law or statutes. What rule law or statute is this in violation of to where it says, you owe the original creditor, and it cannot be sold therefore you don’t owe? Do you have a cite for case that was one using this argument?

Also unless they are an attorney and truly intend to sue you if they threaten you with lawsuit and they're not an attorney you can counter sue them that's illegal

I have sent a letter requesting proof that this debt is mine. They never stopped all contact and collection efforts until they provide said proof. They never responded at all and continue to threaten to sue. I still have my receipt of me sending them a certified letter. I will just use that to my advantage.

I asked for a copy of the contract signed by all parties from portfolio recovery. They sent me a bundle of useless information and told me there is no signed contract because it was applied online and there is no signed application. Is this right?

That is insanely horrible advice. I have been in the litigation collection field for 18 years. All the plaintiff needs is what the state requires, not what you think they require.

The debt collector gets in court and will say they are suing on behalf of so and so. I tryed to fight back even the later saying do not contact me. And i do not own the debt . I still had to pay

Not all debts are bought by the collection Agency, therefore you contact is live and well

I'm in this situation right now. Court date next month. What they have submitted as their evidence is billing statement and the bill of sale when they bought the debt. When I get to court should I ask for them to show proof of my signed contract with them?

Or pay what you owe in the first place to build credits to have betters things in life. This is America you have all the right to be entitled and run from responsibility which will only makes things more harder in the future. Or take the freedom and opportunities you have to make a better, smarter and more efficient budget to live life happily. Don’t touch the fire you will burn. But put your hands near it… it will keep you warm and happy :)

What if you don't ever get information saying you got the debt. Spent 7 year's in Federal Prison. My X ran up debt like crazy. Know my credit is all messed up regardless. 😂😅

If the Debt Collector purchased your Debt without an Attorney present then the debt is not valid . Meaning the collection company can't sue you without documentation that was reviewed by attorney making it legit . Case closed

Had this happen except the suing part. To stop debt collectors in their tracks request the signature card you signed for original debt. 100% of the time they do not have this and they have to respond by letter they do not and most likely they rescend all debt and stop all contact especially if you do research on the collector and they are in deep trouble anyways over harassment 🤣🤣🤣
