This video reviews issues with quitting your job when you're on workers' comp. If you are an injured worker with a California injury, and don’t have an attorney, this video is intended to help provide an overview of workers’ compensation topics so you can better represent yourself.

Many injured workers want to quit there job, but worry about how it will impact the workers' comp case. If you quit the job you had when you got injured, your workers' comp case will keep going. You'll keep seeing doctors and eventually settle. But quitting can impact your temporary disability, and it could impact your job voucher.

Jeremy Lusk is a certified specialist in workers’ compensation with almost two decades of experience, and previously served as a Judge at the Fresno District Office of the WCAB. He has worked out of Fresno, but appeared at numerous Boards to represent both injured workers and employers/carriers.

What I can do with my job?, I signed c and r settlement, the insurance was a agreed to pay the vaucher. I been out 2years My leave end soon
. What is better quit o let them try to accommodate and terminate me because they do not have any job there.

I’m in the process of interactive job placement at my work place as I have permanent disability with lifting restriction. HR said if they are not able to find me a job that is able to accommodate my restriction, my employment may be terminated. If that happens, will I be entitled to the voucher and will I still receive the permanent disability pay? Thanks for your insight. Keep up the great work in making these videos.

Great video yes this happened to me I got released with restrictions no problem bending stupid climbing and no lifting no more than 40 lb at presented this to my job and my job said that they don't have nothing for me does insurance company keep paying me for temporary disability even though I was P&s but was not found p&s by the QME

Jeremy long time listener. Thanks first off for your content . What if no accommodations were offered and restrictions are high but wc doctor states can work modified duty if not on TTD. Then iam terminated because all the diagnostics were approved far too late and fmla / employee medical leave ran out . Is this the grey area of employment law ? And does this improve for wc case settlement time due to a client now jobless ? Or doesn’t play a part in settlement it’s the qme and wc release reports is what it’s mainly about ?

I was released to light duty after almost 4 months of workers comp, My employer says they cannot accomadate my light duty and therefore do not want me back until I can go back full duty. (They can actually do light duty like have me train other techs and answer service calls, I believe they would just rather me be in the field) I have this all in email btw. So I looked for another job and disclosed my injury to the potential new employer (Less physically invasive position that will not affect my injury). New employer has a job offer for me as long as the transparency is there with the injuries which it has been since interview process.
My question is this: Since I was able to do light duty and my current employer denied to accomadate, Can I move on and still get a settlement based off the the injuries (two shoulders and ribs and back from a 10ft fall) sustained from previous employer. I know they may stop paying temp benefits, but those benefits are no where near what I make wether I am on light duty at orignal employer and nothing close to the new employer as well.

I sent an email to my adjuster saying I didn’t want the C&R and they said “fine we will have the lawyers draw up those docs”. I was expecting some pushback. Thanks for your advice last week.

What if my employer doesn’t accommodate for 3 years, and receiving permanent partial scheduled? Can I quit my job? In the process of settling the case.

What happens if I’m done with the 104 weeks of temporary disability and my ptp doctor releases me to go back to work with restrictions but work can’t accommodate, can i start getting permanent disability?

Question my employer wants to cut my salary and seniority because I was out on workers comp for 1 year and three months they say if I don’t accept that offer I can’t return to work can my employer do that ? And is that work place retaliation?
