The only reason you won that. Was because of your C&P examiner being fair and impartial. Most aren't. They was having a good day.

It definitely helped that you did it within the year of separating. Because it was so frown upon to go to medical, i did not have anything regarding several issues that i know for a fact started in service. Thankfully with some buddy statements i was able to win some cases. So Vets, DO STAY IN TOUCH WITH YOUR MILITARY FRIENDS.

Your right being a medical commando was frowned upon especially in the marine corps. However, I did not give a dam I knew I was not faking or malingering. I went to medical regardless of what they thought.

Yes, DevilDog, I am dealing with the VA now for low back pain, Thoracic pain, and cervical pain which I had reconstructive surgery in 2004. Sucked it up during my deployments and training cause I didn't want to be a Sickbay Commando! Sigh Semper Fi and Can Do OORAH

Great info! Btw, if you still have copies of your DBQs, the examiner is required to sign it, so you can find out that way.

You got lucky. I have a documented back injury in the military and I left the military because of my back pain. I've had back surgery and can barely work and only get 30% for lumbar and nerve pain. I've applied over and over again, even unemployability and was denied, they just don't see back problems as a serious disability.

I was diagnosed in-service with a lower lumbar sprain that was 1985 i didn't file a claim til 2011 but my medical evidence stated back pain since 1985 til 2012 also was diagnosed with TMJ for my headaches even had surgery to stop my headaches evidence was from 1985 til 2012 the examiner still stated least likely in service just got low back and headaches approved thru a VES 20 YEARS OF EXPERIENCE MD HER REPORT MATCH MY MEDICAL TO A TEE NOT ONE VA EXAMINER GIVE ME GOOD IMO REPORT AT 90 PERCENT NOW WITH 21 CLAIMS AT THE BOARD WAITING TO SEE THE JUDGE PLUS ALL HAVE BEEN DIAGNOSED WITH A IMO SO NO REMANDS ALREADY HAD TWO OF THEM - RETRO BACK - PAY OVER 11 YEARS COMING SOON - SHOULD ALREADY BE 100 BUT RATERS LOW-BALLED MY RATINGS - THATS ALSO AT THE BOARD TO 7 INCREASES THAT WAS LOW-BALLED - I'M ALL SMILES BECAUSE THE JACK-POT IS CLOSING IN - GREAT video SIR !!!

Great advice. I have back pain all the time. During Vietnam. Draft board past my physical even though I have scoliosis. Crazy!

I won tinitus with no medical evidence or reports in service. My job just qualified me for a presumptive and the C&P examiner was awesome.

Cool story but your first statement and last statement completely contradict each other. And the title and description of the video. Weird.

You know what makes us Veterans go to these other sites. Its the lack of knowledge of not knowing what a VSO can do for us and what kind of things like resources that they provide

listen to this guy carefully. "matter of fact, my back hurts right now" the right things to say to get your rating

Good morning. I have a question. Im a 17-year Army veteran who was medically retired in June of 2021 and awarded 100% Total and Permanent Disabled. In 2004, I deployed to Mosul Iraq on or around the end of Sept that year. Months later, on December 21st, 2004, a suicide bomber snuck into our DFAC, and he ignited a button about 6 ft away from me. The blast knocked my battle buddy unconscious, and the soldiers next to me were KIA. At that time, i had no clue i had a tiny shrapnel in my forehead, which revealed a scar above my left eye. When we came back from Iraq, i was never treated for it, nor was i ever screened for injuries. Keep in mind that this was my first three years on Active Duty. This led to my ETS on 15 July 2006. I arrived at SEATAC airport to check in and go thru TSA for pre check. Long story short. I removed my watch, coins belt and dog tags, etc, into a small bowl in order to enter thru check-in. The alarm went off, and thats when the TSA team waved a WAN over my forehead, and thats when they discovered a tiny metal in my head. I told I deployed and returned from Iraq, and that is when I was allowed to board the plane but was instructed to have the surgery to remove shrapnel. The VA conducted the surgery, and the doctor noted that there were no signs of shrapnel. I disputed this for years and was denied a rating for residual scar from shrapnel, though the evidence is there, but the doctors wouldn't go further. My question is do i resubmit a claim or appeal for denied rating for residual scar from shrapnel though the only supporting documents i have is memorandum of being awarded Combat Action Badge for being engaged by the enemy and my DD214s from that deployment and my last DD214 shows on there Combat Related Disability. Thank you for your time and help.

I got 20% for my back with no medical history. I did my back claim 20 years after I got out, and I didn’t think I would win. However, being a paratrooper for over 6 years made it more likely than not that my current back pain is service connected.

So I am in a middle of a claim now. I got out in 2019, currently doing a claim for my lower back and hips. The VA told me to file for my hips in my letter. The VA recently did an x-ray to my lower back and found lumbar staring and my my disc lost height. L5/S1. I believe this happened during air assault training. Do I have a shot ? My concern is, it has been about five years now. Thanks for your help.

Your story is crazy. Polar opposite of mine and my claim got denied. Injured in service, then diagnosed with and treated (8 months) for lumbosacral strain while still AD. Fifteen months after discharge I filed my claim. Denied due to no current disability. Got an updated diagnosis and a nexus letter, filed a supplement in 2019. Denial upheld. But, the "Favorable Findings" section of my 2019 decision letter said "You have a diagnosis. You have a qualifying in service event. We established a nexus between the two. Claim remains denied." Any thoughts, CivDiv?

You were probably in Syria same timeframe I was (2017 3/6), just found your content great vids man I'm on same boat as you. Because of how frowned upon it was specially as Team Leader/NCO I do not have ANYTHING for evidence but the pain, lack of movement, lose of strength, random spikes of pain are all real. At first you think its temporary and will go away after you realize it's been 2-3 years and it just getting worse.

Thanks for the insights brother, puts me at ease that it may not be easy to claim but it is possible. Semper Fi ! Teufel Hunden !!

I left the Marine corps in 2015, I was having sleep issues. While I was checking out the person doing my claim I told them about my sleep issues like loud snoring, gasping for air, and other systems of sleep disorders. The VA listed my sleep issues as "snoring" and I was never properly diagnosed, fast forward 5 years later now I have severe sleep apnea, and other sleep issues. When it comes to these VA claims it's truly terrible.
