- Brian Reese the VA Claims Insider here, and in this video, I’ll answer the question: At what age does VA disability become permanent? Here’s the short answer: age is not necessarily the determining factor in whether your VA disability becomes permanent.

The VA rater will determine “permanence” of a VA disability if it is reasonably certain (based upon medical evidence) that the level of impairment will continue for the rest of your life. For example, whether you’re 35 or 75 years old it does not necessarily matter. The key point is that your VA disability is unlikely to get better with time.

I'll also define a few key terms around what is a static VA disability, permanent disability, VA total disability, and 100 percent permanent and total disability (P&T). Why? Because they all mean different things!

In 1983 I was honorably discharged and went to the DAV for help with a claim they flat out said “You’re a woman and we don’t know how to help you “, I was absolutely furious, so I went home and downloaded every book on regulation of filing claims. I then proceeded to file my own claim on my own, 6 months later I received a 100% total and permanent. I was 30 yo, I am now 59 and have never refused any Veteran who needs help with their claim and have always offered help for FREE. When my son joined in 2001 I sold my home and drove up the East coast stopping at military bases helping my fellow Veterans, no Veteran should ever be turned away as I was. This month I had to file my son’s claim because the VA was playing tennis with him.

I was awarded 100% straight out of Vietnam. During the 70s, 80s and 90s, I never contacted VA and they never contacted me for 35 years. This was before the computer age or as it was coming online. Since then it's been one battle after another. Never think your rating is permanent.

The VA has always been helpful and going out of their way to help my husband file for disability. They have been understanding and encouraging in every way. He doesn't know yet if what level of disability he will get yet, but the process has been a good one.

I've had my permanent rating sine 2014 without any problems. I was service connected starting in 1988. USAF (1968-1986). Beginning at 10% 30% then to 100%. Thanks for helping out our newer Vets.

Young man you are absolutely right!! I have had my disability rating for 36 years, and its based on the fact I will have this disability with no change for my lifetime. Every morning I am happy to awaken and be with the living! 👊

I have been in the V.A. system for over 30 years. I had been injured in the service and had my service connection since 1987. I have the permanent and total rating under individual unemployability for the last 5 years. I am 66 years old. Most doctors don't understand TDIU and tried to tell me that I don't have free medicines or dental or even free transportation. What I am saying is that there ARE doctors out there that think they have the power to over ride the ratings board decision. The only way this error was remedied was by going to the eligibility Dept. in the regional hospital. When i complained about the doctor writing or reporting that I was "NOT" eligible for dental to the regional hospital I was told the doctor didn't know. If i did not pursue the issue I would not have received further medical care. I demanded another medical doctor closer to where I live even if it meant a private physician. I live in N/W Tennessee, closest clinic is in Mayfield Kentucky, closest regional hospital for me is in Marion Illinois. My Veterans Service Officer was a great help in correcting this error. DONT FIGHT ALONE, DONT QUIT FIGHTING FOR YOUR BENEFITS OR YOU WILL LOSE THEM! The V.A. doctors are tenacious at putting words in your mouth. They are not your friend. I have years of experience about the V.A. system.

My husband has Alzheimers dementia and Advanced Parkinsons. He is terminal under hospice care. V A gave him a rating of 70% service connected. He had double toxic exposure in Vietnam and Camp Lejeune. Should I appeal to get him total and permanent? He is 76 years old.

I don't know, but I'm 60 and I just got my 100% rating, first shot. They said my various disabilities were permanent. But I want them to try and fix some of them so I can get back in the gym and train and work again.

One caveat when discussing these VA examinations...as mentioned, the VA does have rules on when to and when to not schedule re-examinations, however, the VBA was slammed by their OIG in 2018 and again this year for scheduling millions of dollars worth of re-examinations in violation of their own policies.

I'm 61 years old, I just got 100% total and permanent February 2023 for bladder cancer related to Camp Lejeune. But the letter they sent me says in 6 months I will be re-evaluated to see how things are going. They say they can continue to pay me maybe at a lower rate based on residuals. But today I was talking to a C&P Examiner for another case I have pending for kidney issues. And the C&P examiner said it's more like a technicality they have to review the file once a year. The doctor told me I can request that same location which I will, because it's my second time seeing this doctor and I think I got her working in my favor. Definitely do your homework and know the residuals.

Good video, Brian, if a vet applied for P&T and was granted it, would he be paid at 100 %? Does it matter if he was at 90 or 80 prior to applying? Thanks for all the help for vets

As a disabled veteran I Just came across your channel, the reason i subscribed was you dont have your comments, turned off. When I come across channels for veterans that have their comments turned off I dont watch the content and block them. Many content makers for veterans that have their comments turned off are affiliated with and paid by the Veterans administration.

You didn’t cover the laws that are spelled out in the Code of Federal Regulations that refer to your age and the duration of 100% P&T. Maybe you can cover that in a separate video of what happens after you have been found to be 100% P&T and include the spouse in that.

Great presentation. Just got the book. I see you caught the 60% disabled eligibility for the Ohio War Orphan Education grant. I was 80% on the annual May 15 deadline. My 22 year old son got a $ 8, 800 grant to help pay at Ohio State. Since he had scholarships to create an excess, Ohio State refund the excess to him, which helped with living expenses.

So I was given total and permanent disability and also hit the the tag "unemployability" so just like when I was 90% with "unemployability" and paid 100% and considered total and perm then they left that tag on there wtf?

After 10 yrs it becomes permanent and no more eval hubby is about 14 yrs now 100% disability.
