Even if Yuzu shuts down, the source code is already out there. Someone else will take the reigns. Nintendo will never stop emulation or piracy for that matter.

A company suing over an encryption key claiming piracy concerns? The American Bar Association published an eReport on this very issue back in 2007, calling the legal theory that it's illegal to distribute encryption keys "questionable". That said, I highly doubt Yuzu has the funding to fight this if it does end up going to court. Nintendo's almost certainly hoping for a settlement.

Honestly, they screwed themselves over legally by monetizing the emulator *if* the bit about copying decryption keys is true.

1 small problem is they technically aren't selling it. I say technically because in this case I believe the patreon and Google play piece might fail under donating. Don't think that would matter but just figured I'd point it out.

it is said that Tears of the kingdom was downloaded one and a half weeks before being released. I guess they should blame and sue the person who leaked the game.

I really hope that Nintendo *LOSES* the legal case against Yuzu emulator because that can set a VERY BAD precedent if they win this case.

Nintendo has no case. Yuzu itself isn't using any of Nintendo's code. They are allowed to sell it if they like, it's their product.

The piracy claim is also baseless. Just because some people illegally pirated a game and played it on Yuzu doesn't make it the developer's fault. They never acknowledged it or supported it. A lot of people play pirated games on the Switch itself, should Nintendo sue themselves for "facilitating piracy."

The sad thing is that even though this lawsuit if completely frivolous thanks to precedents like Sony v. Universal from the Supreme Court and Sony v. Connectix from the 9th circuit, I don't know if the developers of Yuzu would even want to go to court. Litigation is expensive and time consuming and not many people would actually want to go that through it. However, I seriously hope they either go to court or find a way to avoid Nintendo. Also, I think everybody can agree laws need to prevent strong players from abusing copyright like this.

I’m fine with emulation IF the games are not readily available to consumers at a reasonable price. For example, pirating a 20-year-old Pokémon game that’s like $150 on eBay is completely justified IMO

BUT, I personally do not support pirating current-gen games that are still readily available at retail stores. At that point, it’s just theft IMO

Yuzu is the switch Pro. Would I rather play Tears Of The Kingdom at 30fps with excessive fog or at 60fps with great draw distance? If Nintendo bothered to release a Switch Pro maybe this wouldn't be as much of an issue. I have a switch and it has been collecting dust for ages. I even bought all the games and then played them on my Switch Pro instead. They can sue all they want, but they did it to themselves.

if someone buys a physical game and a physical console it's legally there's to do as they wise as long as the make no profits and even profit that is made goes to the project and not the person
