No Nintendo does not have a case, other companies have tried to do this and have failed, which is why emulators not only are a thing but are pretty universal. The only thing they could potentially stand on is the documentation on how to set up the emulator including getting your own keys.

After the shit they’re pulling with just key codes being implemented in the game cartridges and not the full file. No I don’t think Nintendo should be talking right now.

No Nintendo's arguing their opinion here. It does not match legal fact. Nintendo is not won a case based on that. For an emulator yet.

What they actually went after them for is their patreon But they hosted nightly builds and patches for the latest games and new features. Which is a clear-cut crime.

I normally don't agree with most of Nintendo's court cases, but when it actually comes to not loosing money from pirated games, then I agree. For example, Nintendo ain't loosing any money off dolphin, so it wouldn't make sense for them to sue them.

The developers behind the yuzu emulator chose to settle outside of court so technically while nintendo has won with yuzu and citra being taken down but other game emulators will not be targeted for a while and if they do try then it is possible that they might settle out of court aswell but we will have to see what happens if and or when that time comes.

Courts have already ruled multiple times emulators are fine as long as there not using pirated bios… and they have to prove the bios have been pirated which they can’t. If it was me I would you there sue for frivolous lawsuit and have the lawyer that Tried sanctioned. For filing lawsuits that have been ruled on established case law.
