Can you get a DWI/DUI without even driving!? In most states, yes.

To get a DWI/DUI, it usually means you were either driving or operating a vehicle in some way. Yes, even if you were moving a car quickly, or are sitting in the driver's seat of a running vehicle when an officer didn't see you driving it.

Remember, it's very easy to get arrested for something in the United States. An officer just needs probable cause that you committed a crime, i.e. sitting in the driver's seat when you're clearly impaired. This is why I always say to invoke your fifth amendment right to remain silent, so they can't use anything against you in court.

If he sees you and believes you or someone in the house is in danger, he could kick your door in 'for your safety'. Then, don't say a word and give him a defense for 'he slurred his speech, told me he had been drinking and driving, I smelled beer on him, the car was warm in the garage, etc.

"I do not consent to a search. I claim my Fifth Amendment rights to not speak". That's it. Settle the rest in court. He wants you to speak and get info against you.

It’s a joke since my buddy and I were sobering up listening to music in my car since we knew we were way too drunk to drive, cop pulled up and put him through field sobriety and arrested him. Do better America. We were intentionally sobering up drinking water and planned on napping too, bar was okay with it but cops still showed up and arrested him. Took his CDL from him and ruined his career

Then the law has to be changed from Driving while Intoxicated, DWI, to Operating while Intoxicated, OWI, otherwise its a Constitutional Violation

Coos need to witness you operating said vehicle, otherwise you are presumed innocent until proven guilty!!

If the officer has a legal way to enter your home he will. You are not required to answer your door. If they have a warrant they will announce it if the warrant requires it if not they will just break the door down.

B.s. If they knock at your front door and tell you to come outside , saying you're operating a vehicle and now DUI. WRONG . IF you're sitting in or on your vehicle , with the keys in the ignition , you ARE in control of said vehicle. Or operating the vehicle. DUI, no . OVI ( OPERATING VEHICLE IMPAIRED) yes and you're screwed . I'm 6'2" & 246 lbs, if I have one beer, I'll most likely be over the B.A.L. of .08 . Uber, Lift or a cab is a lot cheaper . ALWAYS drink at home or where you're going to sleep at
