My client (who we'll call Steven), was arrested for DWI WITHOUT even driving! A cop saw him sitting in his truck outside of a bar waiting for an Uber, started asking him questions, and decided to arrest him for "operating" a vehicle while intoxicated. That's right, he got arrested for doing the RIGHT thing.

Thankfully, we got my client cleared of the charges because there was plenty of evidence he was waiting for an Uber and had no intentions of driving, nor had he been driving since drinking.

If this ever happens to you, be careful about sitting in your vehicle after drinking. You never know if you're going to get an arrest-happy cop and face serious charges.

Once found innocent, the arresting police officer should be forced to pay all legal fees of the defense and missed work.

Nothing will change when they are using your own tax dollars against you while you are paying out more for a lawyer. Make it to where the prosecution and cops have to pay out of their own pockets for their wrong doing.

Same thing happened to me and i was asleep for 2-1/2hrs and it took the police 20 minutes to wake me up showing i was not intending to drive but i did not have $ for a lawyer so i was raileoaded and lost everything. My car, home job, family and sanity, and ability to feel like a free man. We have an un-justice system.

The cop should have been made to pay the lawyer expenses.

The message sent is the cop gets overtime to show up for trial.

Of course, As i told a judge once, "Sorry your Honor, I can't afford that much justice" You can only get justice IF you have money!!, A job that will not fire you the moment they hear you got arrested. VERY VERY FEW HAVE THOSE OPTIONS. So very few can actually afford justice.

Yup but then my life is ruined cuz i gotta pay so much in legal fees. Hate that cops can just destroy you like that

Yeah but how much did that cost? Was the guy on the hook for attorneys' fees? Was he reimbursed for it? These things cause damage even if they are bogus. If cops needed to pay for their mistakes, maybe there wouldn't be so many of them.

they even try DUI/DWI for sitting in the passanger seat with the vehicle running. cops are crooked and need to be stopped especially when they try for the low hanging fruit

Glad to see the jury did the right thing. But it's a shame that the police and prosecutors didn't. 😠

Nobody should ever be arrested for drunk driving if they're not actually driving. The whole point of DUI laws is to prevent drunk drivers from operating vehicles at high speed on our roads. That's obviously dangerous.

What ISN'T dangerous -- indeed, its the safest thing a person can do -- is to sit in a stationary vehicle that is legally parked. Whether the engine is running or not. If the car isn't moving, it can't crash into anybody. That's what society should *_reward, _* not punish!

A friend of mine lost his license for two years, was fined thousands and had a record because of this same situation. Some cops are complete a$$holes.

No, the only message that cops are going to understand is taking the lawsuit money out of their Pension fund. Then and only then will it send the message to them to stop screwing around with the law.
