Portable breath tests AREN'T admissible in court, which is why cops LOVE to use them! Even if you blow a 0.00, they know the results won't hold up as evidence, so they often arrest people anyways.

You won't believe how many people I have seen get arrested for DWI when they are dead sober. Cops use portable breath tests to establish probable cause to make an arrest, but if they already pulled you over, there's a chance they already have it. The best thing to do is invoke your fifth amendment right to remain silent and say no to a portable breath test and all field sobriety tests.

That first kid blew a zero and passed the physical sobriety test with flying colors. He cooperated fully and was still arrested because the cop in question was arrogant and stupid and refused to believe him or the evidence in front of him.

Cops will continue to do this until they face penalties that actually work.

I got stopped at a DUI checkpoint for almost two and a half months straight. The fun fact is every time I wouldn't answer questions at their unconstitutional traffic stops. They would pull me out of the vehicle, threaten me with arrest for DUI, and try and keep me in handcuffs for hours in the middle of winter. Eventually it resulted in them getting sued by me for their misconduct, false detainments, and their malicious and unconstitutional traffic checkpoints for DUI checks. Want to hear the best part. Medically I cannot drink alcohol or I will go into some very nasty medical issues meaning I have to be very careful about any alcohol in any product. As such when I showed the judge that I physically couldn't drink alcohol without literally dying yet was still harassed and threatened with DUI arrest. He tore the cops a new one

Then your license suspended for a week (or more). Possibly lose your job and absolutely nothing happens to the cop.

And in my state you lose your license for 180 days if you refuse to participate in the portable breath test.

We're expected as Citizens to know all the laws and how they apply to us on the side of a road when dealing with cops. But they can break the law with no consequences. What a great system

In South Carolina refusal to do a roadside breathalyzer is an automatic one suspension of ones driver's license even if it is found one was not intoxicated

I loved on a state, can't remember which one, but if you refuse the breathalyzer you immediately lose your license.

If you have the option always choose to go with the blood test. It's much more accurate and the blood sample can be tested multiple times.

Either way. Once you are in that situation the tyrant is already set on arresting you. Do not give them more evidence one way or another. And SHUTUP

In Minnesota 2010 the state of Minnesota was forced to send back all the breathalyzer machines. Because they were inaccurate. But it was too late they already charged tens of thousands of people with drunken driving that cost literally millions of dollars and jail time and time off work. Just ridiculous and irresponsible

In Az the law reads "any impairment is impairment " meaning with even a 0.01 you will be charged with a dui.

I have ASBESTOSIS with poor breathing and was arrested because I didn't have enough breath to show on their machine..
