Beating Debt Collectors - Should You 'Sandbag' them at Trial?

We are often asked whether it makes sense to hide - or at least not to mention - an obvious weakness in a debt collector's case. Should you wait for trial? or file a motion to dismiss or for summary judgment? It is a question of strategy, but we argue here some reasons you should consider going with the motion - attacking as early and as often as possible even though it gives them the theoretical opportunity to fix the problem.

This is a verry well presentation in my view. Im not an attorney but I have alot of experience in the court systems especially Federal Court. If I was dealing with debt suit, I would go thru the discovery process and if they can't get what I want, then I will file a Motion to Compel and in camera review and set a hearing. I would do this before Summary Judgment. Everytime this is done PROPERLY they will dismiss the case because the judge will force then to produce the documents.

so how should i go about eliminating a car loan since the debt is not realy mines?

i'm being sued by a debt collector for a hospital bill. I answered the court summons originally, I requested debt validation. After awhile they sent some sort of proof in a letter plus they are asking to have phone hearing on a certain date. They also asking me to call them before the phone hearing to settle. Otherwise it will go to default. What does this mean? How do i approach this from here.

I agree with you there is more than one way to skin a cat. Sometimes it works and sometimes it does not. When it does not, since I am experience with this, I would definitely appeal especially when I know and they know that they are wrong. I like all your videos well presented.
