I HAD MY BROTHER sue the Debt collector for harassment. I had him record the phone calls. He had over a 100 calls in only one month. With the all the time and dates. Plus all the crazy threats. My brother won and got $50k. He only owed $23k. He paid off the debt and he kept the rest. I did get a nice dinner out of it.

THIS MAN IS A SAINT! I am a single Mom raising an Autistic kid and LVNV sued me in Magistrate level court. I had just spent all of our money on supplies so I couldn't pay an attorney.
I spent 10 days studying with this genius and learning my rights about consumer protection and my state laws.
I watched Attorney Skibas videos every night to keep hearing the same terms
I familiarized myself with the documents the debt buyer would bring. They were spot on. They brought sloppy records, no names, bad dates, partial records, exhibits that were just made up the night before. Thanks to Attorney Skiba, I was able to challenge every one and request full purchase agreements.
Yesterday the Judge ruled in my favor!!!!
I AM FOREVER GRATEFUL ALL THE WAY FROM THE EAST COAST FOR ATTORNEY SKIBA!

Let me make this extremely simple. If a collector calls you, ask them for a copy of the contract you signed with that company stating that I agreed to pay any money. If they can't, and they can't, tell them to take you to court or take it off your report. If they don't they will be sued. Or dispute it in credit karma with 2 words. No contract. that one is the easiest.

If you are living on social security, you are deemed uncollectable. They will get the judgement but will not be able to collect a dime.

I fought them and they folded like a lawnchair when I kept showing up. They agreed to a dismissal with predjudice if I agreed not to sue them. The judge seemed confused by my actions and even asked if I had a lawyer friend😊. I even schooled her on a Florida Statute regarding presenting case law in small claims. Everything I did I learned on youtube. It was hard and I cried once on my out of the courthouse but I'm so glad I fought. If it was my original creditor I would have paid but it was a junk debt buyer who bought my account for pennies on the dollar in a bulk purchase. Its a scam and once I found that out and how they operate I was infuriated and determined to fight!

Debt collectors cant sue anyone without the original documents signed by the person thats being sued. They cant use copies of it they need the original which 99% of the companies that sold their debt either dont have or cant find. Ive been sued 3 times and won all 3 because they didn't have the original documents

Thank you for taking the time to present to the layman the conditions of this unfortunate thing that happens to regular people. When the credit mafia comes after us, we need an advocate!

Unfortunately debt collectors like Portfolio try to keep you from knowing about a court date by having the summons signed by someone besides the debtor. I've even heard that some of these bottom feeder companies even forge a debtor's signature on a summons. Then when the court date arrives only the debt collector shows up in court, the judge has no alternative but to deliver a default judgement. Never, never, never ignore debt collector letters. Respond within 30 days with a letter requesting validation.

I had a crooked judge ignore contract law and refused to honor the binding arbitration part of the credit card agreement when they sued me. The lawyers told him that it was too expensive for them to go to binding arbitration when I pointed that out to the judge. They filed papers and never sent me a copy of them and the judge did not care at all. The crooked judge signed the judgement on Wednesday, I saw a bankruptcy lawyer on Thursday and filed for bankruptcy on Friday. Imagine to my surprise when the lawyers 'offered' to cancel the judgement on Monday. Nope. Discharge was 2014 and my life is on a cash only basis. Life is good.

How do these companies buy our debt and then cry that we dont pay them. Dont companies take this money as a loss and report it to the IRS ?

People dont understand that debt collectors take a gamble and BUY a debt from the establishment you had a CONTRACT with, at a discounted price, in HOPES that gamble pays off. At NO point do you have a contract with the debt collector, until you agree to it. Therefore, since no contract, you have no obligation to pay said collector....never ever admit who you are to a collector, nor admit to the debt, save yourself the trouble.

I got a summons for not paying on the taxes on my house. The Parish sold the debt to a collection company. They claimed that I have never paid my parish property tax. I talked to the city and they confirmed my city taxes were up to date. I did not pay my taxes, the mortgage company pay my taxes. When I called the mortgage company I got a young man in their Phoenix office. Together we went through my account. After 10 minutes the man said he found the problem. He said that the county taxes were supposed to be paid to the local parish. He said that his company does not pay church fees.

It took me several minutes to stop laughing. I said to the guy, you do know that counties in Louisiana are called parishes right? After he was able to breathe again he said he had to talk to his manager. They called me 5 days later and said that the misunderstanding had been resolved.
