Yes, proper action on your part. And beyond, if you receive a judgement from the small claims court that doesn't ensure you will receive the judgement amount. At that point you must wait the legally specified amount of time for payment then exercise a lien against the other party, which includes having an appropriate agent such as the sheriff, to tag items owned by the defendant who lost. Then you must wait the appropriate specified time again for the defendant to pay. If at that point no payment is received you can then authorize the tagged property be sold at a sheriff's sale or other appropriate specified legal mechanism. I've used this process myself and it also requires patients and perseverance. I once had a new car dealer to have cars and desks in their showroom tagged in plain sight of perspective customers. They wound up paying me in total so they could remove the sheriff tags, pronto. Thought you'd enjoy that info. as well.

Thank you so much for this, I’m in a super similar situation and am bracing myself for the process. My car is only a year old with 20, 000 miles, pre-accident was worth about 25, 000. And has 8, 500 in estimated repairs. So I absolutely want to pursue a diminished value claim. This is an incredible resource, and from the point of view of a regular person and not a lawyer is so valuable.

That is crazy. USAA definitely paid more money by paying people to respond to emails and hiring that attorney than if they just paid the initial amount from the start. Good job going after them king!

Everything is exactly like you said. So mine is took like 60 days total I think. I ended up getting over $4500 from $36. It's not easy but it's worth it. Hey man, I just wanted to say THANK YOU first off. I am near Dallas as well, earlier this month a lady hit my parked vehicle that didn't have a scratch on it and did over 8, 000 dollars in damage. She has USAA as well, so your step by step guide has been a LIFESAVER! I just got my vehicle back yesterday from the bodyshop, and I just talked to their adjuster/claim rep about diminished value this morning because of your video. Funny enough I just got the same forms to fill out from USAA to start that process. I already took your advice and reached out to Tiger DV as well to get a estimate/claim from them. I'm about to embark on this process. My car was rear-ended 8 months after buying it brand new. The body shop has had it for almost 2 months and USAA refuses to do anything about a DV claim until the repairs are completed. I sustained a whiplash injury and it further complicates things. The body shop gave me an initial estimate of 6K in damages. My car barely has 4, 300 miles on it and has all premium features. I'm not looking forward to this process.

I'm going through this now and it's been a nightmare. The adjuster told me once my car is repaired I won't have Diminished value. Finally got past that but she and the adjuster who worked up the estimate have lied to me. Have spent hours researching and my car isn't paid for so any after market parts could void my warranty. I have a good idea I'll end up filing a lawsuit although I don't want to. The at fault driver was driving a company car and I didn't realize until after we left his name wasn't on the card. It's a lot of good info in a short-ish video. My take is that insurance companies will double talk you to death if you let them. Your info is a nice set of notes on what to expect (get your Vaseline ready!) And how to keep your wits about you in dealing with something like this. Most folks will roll with the first offer even if it's as stupid as the one USAA made to you. Kudos on fighting them and winning

Thanks for this! My vehicle was recently involved in a hit and run and USAA sent me the Diminution Form and I was Uh... what the heck is this?...lol... I had to look it up. Good information. I'm going though the same thing with State Farm. My DV appraisal was for $6, 950, they offered me $66.50. I am attempting to subrogate through my insurance company but I am fully prepared to go to court. I'm being sure to keep up with all my time and expenses.
