Winning Strategies for Depression Cases | Social Security Disability

What does it take to convince a Social Security disability judge that the clinical depression you struggle with is truly disabling.

As you know, SSA defines “disability” in terms of how your medical or mental health condition prevents you from reliably performing even a simple, entry-level job.

In the case of depression, your symptoms must interfere with your capacity to focus and concentrate, behave in an emotionally stable manner and interact with co-workers, supervisors and the general public in a manner appropriate to a business setting.

Like all other potentially disabling conditions a diagnosis of depression is NOT enough. Your case file needs to contain on-going treatment records from a psychiatrist and a therapist (such as a psychologist or licensed counselor). Generally speaking, talk therapy with a social worker will not be enough.

As I discuss in this video, judges look for evidence of severity. Have there been recent suicide attempts? In-patient mental health hospitalizations? Medication trials that either don’t or need increasing dosages? Activity limiting medication side effects? Evidence!

Third party statements can also help: Will friends and co-worker submit statements discussing crying spells, poor personal hygiene, or episodes of inappropriate or disturbing behavior?

A high percentage of people applying for disability include depression as a disabling condition so judges will generally find mild to moderate levels of depression not to be at a disabling level. If yours is extreme and the evidence supports your assertion, your chances of winning disability benefits go up.

I won my case in 2021. I’m writing to tell my story in hopes it will help someone. I was the owner of a company until 2019 when I got so depressed things just started to fall apart. I couldn’t keep up with the demands of work and take care of myself. Then, in 12/2020 I got Covid which made my depression worse. When I decided to close shop, I went to my PCP asking for a referral to a psychiatrist. Luckily I found someone who believed in me and who tried to help. We tried so many meds and TMS therapy. I was never hospitalized for depression but I have tremors and tics associated with anxiety that make it difficult to work. I was 47 when I applied. I also have a history of diabetes, high blood pressure, insomnia, agoraphobia, and sleep apnea.
It is so important to follow doctors orders, not miss appointments and advocate for yourself to get the help you need.
It’s still a struggle but having steady income and knowing my medications and doctors visits are covered is one less thing to worry about.

I am a Registered Nurse and I developed multiple health and medical issues after contracting bilateral Covid pneumonia on my job in 2020 while caring for a patient whom I contracted it from. MDD, severe anxiety with panic attacks and PTSD to name a few. Thankfully I was paying for a STD/LTD policy, I had workers comp and this year, 2023 I received a fully favorable ssdi awards decision from an ALJ! I am 53. I discovered your YTC and began watching & learning how to be my own Nurse and advocate throughout the numerous Doctors visits, blood transfusions, total therapy sessions etc . I appreciate you for what you do Sir! ❤

Listen to this Man! I didn't have a lawyer but in 2019 I won my hearing because I prepared my case perfectly because I studied his videos and it worked for me. It will work for you if you apply what he is teaching.

I have been on meds for major depression. I also have anxiety and schizophrenia. I filled out a CDR form in January of 2021 and got approved in June of that year. I have trouble concentrating, laying in bed all day, not bathing regularly, etc.

@johnathan how are you not internationally known! OMG your videos are a GOD SEND! I would have neverrrr thought past saying im severely depressed cry a lot and cant sleep. I lost my husband to COVID 11/13/2021 30 years together 8 kids. Healing from car accident 7/14/2023 broken knee, 1st metasal displaced broke in half had surgery with Hardware. I wasn’t at fault but have terrible PTSD cant sleep more than a couple hours w/o waking up. I understand how you worded things. Omg THANK YOU

I have been seeing a psychiatrist and a counselor or therapist for 17 years. I have PTSD from getting drugged & raped by 4 men in 2006 and haven’t worked since then. I have documented major depression disorder, PTSD, GAD, Panic Disorder, ADHD combined. I’ve got a lot of medical issues like Gastroparisis, chronic pain syndrome, daily headaches & migraines about 3-4 times a week. I also dissociate almost every day. I just remembered there was one time maybe 10 or so years ago that I woke up in a hospital and found out that I was trying to fight the cops and other people with a nail file and biting. My hearing is in the morning with Judge Patricia McKay who has a 38% approval rating. This is my 2nd hearing, I had one in 2018 and was found unfavorable. I don’t remember a single thing from that hearing. Nothing at all. Any advise would be so greatly appreciated ❤

depression was added to my case post op. Mainly bc I was under impression I would cure of pain after cervical fusion. My psychologist is GREAT she doesn’t prescribe medication (psychiatrists prescribed meds) she provides coping tactics for pain management.

I had my hearing today. It came up that I had smoked cannabis in my medical records. Do you think the judge would ask for a drug test before she makes a decision?

Thank you! Going for my second attempt re: bipolar, borderline, anxiet depression. Lost every job (prob over 12) for past 10 years. Previous solid history of work. I’m 55. I can’t do it anymore

this felt like it was describing me in every way possible.. I applied but I didn't say I had two suicide attempts one I was rushed tithe hospital and the second one I was taken to a behavior center and was finally diagnosed with severe depression and bi polar disorder. my brother of 3 mi the died in my arms when I was 7 and he was my only sibling. that caused me to grow up scared of being near kids, I have acne and that makes everything worse, I'm insecure, I call in work if I feel my acne is embarrassing. I sleep all day when I finally feel tired after being yo for 2-3 days, I'm always losing jobs because of missing work. I sometimes don't brush my teeth. my grandfather who I lived with for half my life died and made me his beneficiary and I barely found out after him being dead for a year. I have more ti day but I'm saying too much and it's hard for me to vent or be vulnerable

I was approved for SSI but not for DI because of not anuf work credits .57 Married Female . Husband is filing for retirement .They say I don't receive anything because husband makes to much.We can't even get help from welfare so I can't even get Insurance or food stamps or cash assistance is there anything I can do.Social Surcurity said I was disabled but not at the end of there finding but if anything changes I can send more info into to them . What do I need to do .Thank You

I am at the brink of suicide due to my depression and other trauma. How can I get a hold of you to maybe talk about my case. I been seeing a psychiatrist, therapist for years and I don't seem to get better. I am working with my psychiatrist some options treatment, but I just feel like I have no way out and just want to no longer exist

I have bipolarism and I am waiting on a hearing soon. My attorney is positive about it but I am not. I have my first phone meeting to talk about the hearing next week. Any tips at this point?

This guy is good. I'm in reconsideration going on for a year now. I just had a DVT and PE and on blood thinners and thats a new developmet that happened. Origionally my disability has been palpitations of various sorts and afib and a couple of anxiety disorders and I'm on zanax and prozac and now blood thinners. I got my fingers crossed. But I'm 591/2 so if I'm denied I will be about 62 before I see a judge the way things have been going. So I don't expect reconsideration will be approved but I'm hoping but I figure turning 62 will be when I start getting money. Anyone have any informed opinions or experience? Do you think I may get approved but starting date from when the DVT and Lung clot? And I also have been to a mental health facility since I got denied first time and now am on Prozac
