UPDATE....orignally the contract said issues were to be handled thru mediation, but bc of public backlash Disney changed its stance & it is going to court.

I wish more people knew that the clause in that (or any) contract can't take away your right to sue. It only says you have to try arbitration first. If the contract holder does not offer acceptable recompense, you may then go to court.

As a lawyer I can confirm Disney made its position weak by pointing this out. Their best defense was to reject any liability within the scope of incident. So if you are pulling out a bogus contract that was established without the presence of any legal advisers, you are claiming that if this contract did not exist, you were liable for the damages. I hope this becomes null and void in the Supreme Court.

So I used to handle Probate and later government contracts, it's absolutely illegal and uninforcable to have anyone sign away their rites to sue for damages because you don't have the legal authority to remove their obligation to follow the law. A lawyer worth half his salt can get this handled.

Can't do that in the UK. We have a law called the Unfair Contract Terms Act. One of the conditions states a company cannot indemnify itself against negligence!
