Jeffrey Piccolo filed a wrongful death lawsuit against Disney after his wife Dr. Kanokporn Tangsuan died from an allergic reaction after eating at an Irish pub in Disney Springs, court documents state.

Disney, however, asked a Florida court to dismiss the lawsuit, arguing that Piccolo had signed up for a one-month trial of Disney+ in 2019 and the terms and conditions stated that Piccolo would settle any lawsuits against Disney out of court through the arbitration process.

Attorney Erin Ehrlich Caro joined LiveNOW from FOX's Josh Breslow to break down all of the legal issues involved.

Wow. Disney MUST be broke. To use their streaming service…as a defense in a $50, 000 wrongful death lawsuit.

That is probably the most despicable article to add in any T&C

Well, Disney has officially lost me as a customer. This is a really crappy thing to present in this case. They can't just admit they screwed up? How long until they start poisoning kids because of their negligence?

This is one of the most absurd things I've ever heard!

Typical corporate legal completely dismissive of human life. How do those responsible even go on living with themselves?

This is honestly disgusting. How does a Subscription Service has anything to do with an In-House negligent customer death?

Why aren’t there mass protests about this!?

I hope the judge throws the book at Disney. How could they possibly cover food negligence with T&C for a membership for Streaming Services?? WOW! Lesson here - DO NOT book anything through any service you have a contract with for anything else (especially Disney).

50k seems a bit light for ending someone's life, I can't believe Disney is this petty.

Cancelling Disney… the question is why is this clause even necessary in a terms and service agreement in a streaming service… someone lost their life

We were headed down to Disney when Covid hit. My wife, her sister, three grandchildren and I all with purchased tickets. Thankfully we were driving. We hit Chattanooga Tn for a night stay when my friend in Orlando told us not to come down. Disney had just closed all parks. We were never refunded. Our hotel refunded us, but Disney... NO.

The hospitals make us sign that they are not responsible for their medical negligence, it is an agreement that threatens life and yet it is legal.

The fact that Disney can even dare to suggest this legal move has killed any good will I ever have with anything from the mouse. Not a TV show, not a Movie, not even a song played from a radio. No Disney ever again.

At this point, disney needs to pay a lot more than 50, 000. It needs to be enough to hurt disney as a company

Disney honestly will lose more money on lost customers because of this situation than if they just bucked up and payed the goshdarned $50K lmao

So the man's signature to an affiliate streaming service applies to the woman's body? How is that fair? Yes they are married, but it is HER body!!!

Let's speak with our wallets. Got a Disney account ? Let it go. Planning a trip to Disney but you haven't bought in yet? Don't.

This move by Disney does not surprise me at all... They are all about the money... Their own people and clients not so much...
