Contacting Your Claim Adjuster While Having An Attorney

There is a misconception that once you have legal representation in the CA Workers' Comp System, you can no longer contact your Claim Adjuster. Luckily that is not the case. You can actually contact them and it's best to do so to help try to get your case moving faster.

Once you are represented by an attorney, you can work together as a team to get things going for your case. However, there will be times when a claim adjuster might tell you to speak to your attorney, simply because they don't want to have to deal or speak to you. It's a tool to deflect.

If you do speak to your claim adjuster, make sure to run it by your attorney first and don't say anything to them that can later be used against you.

My personal injury case was closed in April 2023 however I'm trying to find out if it's possible to sue the insurance agent for refusing to talk to me about my case once I had fire attorney B - the adjuster said he needed a withdrawal letter from attorney since he was a lienholder- but I fired attorney B already and adjuster still refuse to listen to me. What shall I do?

I also have a similar situation where the insurance is delaying my workerscomp check even though my employers Dr gave me restrictions that are not being accommodated. So I've been out of work for two months without pay? My lawyer just told me they left a message? It is frustrating.

I asked my claims adjuster through via text my claim number and she responded and had given my claim number to me but also had asked if I had hired an attorney. I didn't respond back at all. Because that wasn't apart of my question I had asked. Think it's safe not to respond back.

At 25% and charging $450 an hr to the insurance company, guess what? You can contact them. As a team I am putting money in your pocket and your job is to earn it.
