How to Avoid Trick Questions from the Insurance Adjuster

We advise our clients and potential clients to avoid speaking to the workers’ compensation insurance adjuster on your own, without the advice and guidance of a lawyer.

As I discuss in this #shorts video, there is very little upside to speaking with the adjuster and many potential pitfalls.

First, never forget that the workers’ compensation insurance company and their employees are not trying to help you. Their goal is to minimize what they have to pay for TTD (missed time from work) benefits and what they have to pay for medical care.

As such, they will refer you to doctors who work on behalf of the insurance company. Claims adjusters will often contact your doctor after your appointment to encourage the doctor to release you to full duty work, or very minimally limited light duty.

So in any conversation the claims adjuster will ask you questions designed to minimize your injuries. If, for example, you fall and hurt your left shoulder badly, you will naturally focus on your left shoulder. You may have also hurt your right wrist but if all you speak about is your shoulder, the insurance company will deny coverage for your wrist injury because it was not part of your conversation.

Even a seemingly innocent conversation like “how are you doing” can come back to bite you if you respond “pretty good, how are you?”

As your attorneys, we will ask you about all injured body parts and we will disclose all injured body parts in writing to the adjuster. We will also help you word your statements to cover everything.

Workers’ compensation in Georgia is extremely adversarial, meaning that insurance companies assume that most or all injured workers are exaggerating their claims. They will not assume that you are honest and question everything about your case. If they can find a reason to controvert (deny) your claim they will even if they have to use a technicality to do so.

Don’t give the insurance company anything they can use to deny or downgrade your claim. Let your attorney do the talking.
