- Foster claimed that he had taken sleeping pills and drunk beer before falling asleep while Ward and Pal were kissing. Additionally, a letter Ward wrote for Foster was discovered in their motel room where he admitted to drugging him, and that he “Mary rode (him)” while he slept. However, despite his claims of being drugged or incapacitated during the crime, the evidence presented led to his conviction

- DNA evidence showed that both Foster and Ward had sexually assaulted Pal before her murder. Foster's DNA was found in her vagina, while Ward's was found in her rectum. Additionally, Police found various items soaking in cleaning fluid in Foster's truck, including shoes, gloves, and tools. An expert testified this could make DNA recovery on these items almost impossible.

- While Foster requested this spread for his last meal, this was for an earlier scheduled execution date in 2011. Due to his execution being stayed multiple times, by the time of his actual execution in 2012 took place, Texas’ final meal policy had changed and he was not allowed to choose a special last meal.
