I was sued by a debt collector last yrear October 2021 amd within 2 days I filed an answer that is where people who are being sued fail to do and that why the collection company gets a judgement again them. Last Friday Sept 30 2022, was my virtual hearing in small claims for my 4k. While waiting to sign by the court clerk I overheard the plaintiff attorney that they were not going to pursue the case due to statue of limitations had expired (4 yrs in CA).
Before my case the only question I was asked by plaintiff attorney was if I wanted to settle I said no. Then proceeed with the judge to hear my case and judge agreed and DISMISSED with prejudice due to SOL had expired. Every state has a statue of limitations look into it and good luck.

I had a debt collector try and "collect money I owed" I told them I'm not paying a cent till the dispute has been completed; then they tried to use "oh but if you make payments now and the dispute goes in your favour then we can refund you the full amount" I told im not paying a cent and hung up on them!

Going to have dissent here. Speaking from personal experience (not legal advice):

If you've been sued the first thing you need to do is answer the complaint against you. If you don't you'll default and you've lost. You can request validation if you wish, but that doesn't stop the lawsuit.
Next, they are going to hit you for a motion for summary judgment. While these are sometimes winnable most people don't have the legal know-how to put together a defense here and often lose. Now you have a judgment for the full amount they asked for, plus some.
If you've been sued and don't have a legitimate case of identity theft; you're not bankrupt; or you have zero income or assets--- your best bet is likely to settle. If you can offer them 20-30 cents on the dollar they'll probably take it. Also be sure to get a dismissal with prejudice. Did I mention you need to answer the complaint right away?

So I went to court the case was dismissed they said I did not owe anything because they cannot prove that I owe them and second of all this is still on my credit report how do I get that off and this was over a year and a half ago
