I was sued by Mudland and discovered from one of your videos they violated my rights according to 15 USC 1692g. I filed a complaint with the CFPB and BBB and they didn't show up for court. I was a little disappointed that the judge didn't dismiss the case but continued it for 60 days. Hopefully they will dismiss it all together

No one has any power over you unless you give it to them. Lack of preparation can be a form of giving away your power.

If you were sued by a third-party, tell them that you want the original contract with your signature and have it copied at a notary Republic and send it to you certified mail. Do everything through emails or letters. They do not have these documents they cannot collect.

Thanks for this. This is much more competent information than just the "don't pay a debt collector" advice. Either pay for a lawyer to help you or just pay the debt collector pennies a month forever.
Then again this video is being made by a lawyer so it could be that you don't always need a lawyer and he's just trying to sell his business. Either way eases my nerves.

So I found out that LVNV just filed a summons on 7/26/23 and previous to that I got a letter stating that Resurgent is their servicing agent to collect-it’s all confusing! Back to the summons…I haven’t even been served nor hasn’t been mailed to me. I found out about all this because they called my Dad with a file number and I looked into it. My Dad stated it started with the alphabet “CV” and so he thought it might stand for civil case? I looked into the clerk of court website in the Florida county I preside in, and it shows it was filed under LVNV and it gave a summons for the second week of September. My question is, if they never serve this summons by mail or in person is it a valid summons and should I respond back and ask for a settlement before this summons date? And is there a timeline of when there supposed to serve it? It all seems pretty fast. I’m pretty confused and have never dealt with this kind of situation before.

I wish this stuff worked on Portfolio Recovery they are easily the worst and relentless. Even with the CFPB lawsuits they don't bat an eye and file multiple lawsuits weekly. I even filed a complaint with the CFPB and it was closed because Portfolio responded with some bogus message. I wish there was an attorney in VA most lawyers just want to file BK.

What if you had business and repo the vehicle and commercial company acution equipment and now sending me remaining and i not making money to pay, i tried to pay what i had left but they want sue i sent them money and they say or sent anything.

I’m going through that now. I don’t see that debt from Capital One on my credit report, but the debt collector contacted me to make a payment.

Collection Agency LNV funding asked for my dads email so they could send him a letter saying it isn’t his debt . The guy he talked to said it would take a couple days to send because it goes to a different department! Talked to them on Wednesday 04/19/22 if we don’t get the letter by Friday 04/21/22 he’s going to counter sue.

just tell them you have no knowledge of the debt. They have to be able to prove it is your debt. If the amount you owe isn't that much...they will not take you to trial and will dismiss it. It won't be worth their while.

A summons was delivered to a vacant home I’ve never lived in. Received a letter in the mail at that address saying I missed a pre-trial conference. One of the guys painting at the house, signed the paperwork not knowing what it was. He said he told the person he was just there painting, but I never received the summons and knew nothing about it until I called the repair guys to see if either of them communicated with a courier. I’ve never used that address on any credit application, because I don’t live there. Yet, they never sent anyone to my address on my credit file and I’ve had an ongoing dispute with Midland, since last year! Now, I have to petition the court to reverse the default!

I live in Texas and being sued by LVNV. I’m pretty sure the statue of limitations on this debt has run out. I haven’t been officially served yet but I know it’s coming. When I get served what do I do? Or should I contact them and let them know that the statute of limitations is over.
