Was in Magistrate’s court one day. This HOA president had a home owners car towed because the tag sticker had expired . The home owner lived out of state and used this residence as a vacation home. The county sent his vehicle tax notice in the mail which he paid and they mailed him the new registration. He planned on replacing his tag sticker on his next visit. The towing company stored his vehicle for a couple of months the then he gets a letter in the mail stating that his car was going to be sold in a judicial sale to cover the cost of the towing and storage fees. He had to make a special trip and fly down and go to court. The HOA’s argument was the car wasn’t legal to be on the road. The judge asked how did you determine this? The car was legal because the taxes had been paid regardless of the outdated sticker. The HOA had to pay the towing company and was sued for the travel expense and loss of wages due to the home owner having to leave his job to come to court.
