an HOA should NEVER have the power to foreclose on a home owner. In fact, HOAs should be outlawed.

The good news is he won - "Dismissed as of January 10th with all parties to pay their own court costs"

Update: he easily won in court, the HOA then proceeded to ban him from "all use of any and all of the common facilities for a period of one (1) year" for no other reason than they were salty they couldn't kick him out of his home

I was building a patio for a customer years back, is HOA said patios and decks could only he a certain square footage and could not extend beyond 15 feet front the house's fondation, that left them with very little room for their furniture and grill. Since there was no restrictions on landscaping I placed two large patio slabs just off the main patio so he had a place for his grill, his HOA rep was NOT happy buy couldn't find any infraction that covered his gripe, but he never forgot. A couple of weeks later I was a few houses down and the guy walks over and told me he received a HOA citation for not having a over on his grill. Turns out he cooked a couple of steaks and left the grill to cool down before putting the cover back on, it started raining so he left it to early the next morning to covered it. The only way to even SEE the grill is to actually walk behind the row of houses through the 10 foot wide area the builder had to leave beyond the 15 toot lot envelope, the only people that go back there besides the home owners are the lawn cutting crews...and apparently the anal retentive nightmare of a HOA nazi out on a rainy night looking for revenge.

BTW the guy took his citation to the full board, explained what happened and got the violation overturned.

I knew this woman who ran an HOA & they didn't even allow you to park in your own driveway overnight, you were supposed to use your garage and couldn't have more vehicles than your garage could house. Crazy. I looked into it, these cases were dismissed.

I’m a Brit and absolutely shocked that this goes on. We don’t have HOAs thank god. The fact they can sell your house is ridiculous, the HOA are petty dictators

Bought into an HOA, I had a Chevy Blazer that didn't fit in the garage. They had a "no trucks parked in the drive way" rule. They took me to court over it. I won by pulling out the registration that categorized it as a station wagon.

Here in Australia as long as the car is registered they are not allowed to dictate if you you can keep it on your property they can only do it if the car is in non running and unregistered

HOAs are ran by kids that got bullied in school, so now that they're adults, they think they can get away with being bullies themselves. I swear, HOAs should be outlawed.

That's a damn good looking truck, I'd love to have it in my driveway.

My dad did auto mechanic and auto body. This is only paint wear. This is a classic truck which probably qualifies for historic plates.

I dont see any body damage to this vehicle from this clip.

Auto damage to me is when your in a car accident and its damaged fenders, mangled car parts, missing car parts and the like.

The HOA thinks his truck is an eye sore.

If the man is paying his bills and HOA fees, they shouldnt be able to foreclose.

It seems the HOA is being greedy, wants more money, and unreasonable.

I hope the court and judge see this is a classic truck and its on his property, not the street.

I once lived in a neighborhood that had a HOA. One rule was no utility trailers allowed to be parked on the driveway. I had one I kept stored under my deck in my back yard. I used it one day and when I was finished I parked it in my driveway intending to put it back under the deck the next morning. The next morning I had a letter from the HOA in my mailbox already with a picture of my utility trailer parked in my driveway. A note was with it explaining I was in violation BLAH BLAH BLAH and had something like 2 weeks to rectify the situation. So I let the trailer sit there up until the very last day I had to "rectify the situation" and THEN I moved it back under the deck in the back yard rather than moving it the very next morning after having used it. Reminds me of that quote: "Don't hate the player. Hate the game." And reminds me of an old Charlie Sheen quote: "Winning!" 🤣🍻
