Red yeast Rice extract was considerd to be not to be a food (a supplement) because the courts ruled that this variety of rice was developed specifically for creating MONACOLIN K (lovostatin equivalent). So it was ruled that since it is not really a food, it therefore should not be sold without prescription. Another concern was that red yeast rice could have some adverse effects on some who consumed it in place of a regular rice.

In the USA, supplements are regulated as a subcategory of food products. Therefore the label cannot claim to treat any disease, but no prior authorization is required to market the substance. In contrast, in many other countries, including Canada supplements are regulated as a sub-category of drugs or therapeutics. So a specific license is required, like a DIN product (drug). But pharma leaves no opportunity unexploited. Pharma companies are the largest sellers of supplements (e.g., vitamins)!

This is a very good medical education channel.
