false accusations of rape, should be punished with the same amount of sentence/jail time/fines that the accused would've received if found guilty. the accuser needs to be punished.

Being falsely accused is an evil act 2 do 2 somebody that didn't do no bad doings, the person that started falsely accusing ppl should b locked up for 20 years in prison besides instead of falsely accusing ppl just admit 2 wrong doings or questionable things & b honest if ppl was honest false accusations would not b occuring in the 1st place, ppl need 2 stop lying that's what needs 2 happen

Another example: suppose you tell the detective "Nothing happened. We watched a movie at her house, then I left and went home to bed." You've just proved half their case against you. Proved you know her, proved you were alone with her at the scene of the alleged crime. You're that much closer to a conviction.

Good advice! It reminds me of the rape charge against Joseph in the Bible (see Genesis 39). He in all likelihood didn't talk because it would of done no good. He trusted in God and made the most of his situation. He eventually was able to save the lives of tens of thousands of people from starvation.

Best advice I have for anybody looking is don't talk to police. Anything CAN and WILL be used against you in a court of law. If there is an accusation against you they are NOT trying to get your side of the story. They ARE currently building a case against you beings they work with the state attorney. Also know your right to remain silent is NOT AN ADMISSION OF GUILT. Talk to only those you trust with your life because right now your life depends on it. If you only listen to your attorney especially a state appointed defense attorney they tend to be over burdened and work closely with the state. What this means is they may try to get you to take a plea deal to a lesser charge with an ADMISSION OF GUILT. If you are innocent this can be extremely insulting!. Be prepared to fight for your truth the rest of your life in prison or outside free with a lifetime of trauma. You really don't win either way. PRO TIP: read up on your local laws in the law library to discuss with your attorney to know that you are being best represented with the best defense possible. Nobody is going to fight for you unless you have lots of money. If you have a court appointed attorney you do not have money therefore you have to be prepared to fight for yourself. Hold your defense accountable by the standard of your local laws. If you are guilty you are not getting away it but if you are innocent the truth will come out it always does!!!

Wish I had known this a few years ago! I think what tipped off the investigator not to F with me was that (among other things) I pulled out my cell phone and audio recorded the entire questioning session! The video i'm making about it (in the larger theme of this #MeeToo - accusation based day and age, is going to have the entire audio of that questioning!

Yes. The important thing to remember is PROBABLE CAUSE is not the same as having enough evidence to take a case to trial. If they can prove the two of you had sex, that's generally probable cause to at least arrest you. But if that's all they can establish, they will likely have to drop the charges because they need to be able to satisfy the legal definition of rape in court.
