More Failed Constitutional Amendments

Article V of the constitution provides for how to change the constitution. Amendments must first secure the support of two thirds of the House of Representatives and two thirds of the Senate. Then, three quarters of the states must ratify the amendment for it to be added to the constitution. Alternatively, the states can call for an article v convention to amend the constitution, though this method has never been used successfully before. Because the amendment process is so arduous, most of the roughly 12,000 proposed amendments failed. So what are some more of those failed amendments?

Interestingly enough, regarding duels, they’re still legal in Massachusetts, as long as you invite the governor

I find it funny that the supreme court deemed banning child labour as unconstitutional

The 1st Amendment only prohibits CONGRESS from establishing a national church/religion. It still allowed for individual states to establish "official" religions, and stuff like that.

The 14th Amendment is what finally made it unconstitutional for states to do that.

If we did ever have an article 5 convention it would most likely be a term limit/age limit for members of congress. The senate at this point is just a care facility for the elderly.

How the hell did this comment get so popular?

The biggest problem with an Article V convention at this point is trusting contemporary politics to produce something reasonable, effective, and sane.

Would an article v convention be any less partisan? I seriously doubt it. Neither party even controls 2/3rds of state legislatures and it's hard to find common ground these days

An Article V convention might be even more partisan, given how unevenly populated the states are.

“I disagree with what you say, but I will defend to the death your right to say it", thats Voltaire btw

In Oregon, we have something similar to the dueling ban amendment in our state constitution, Article 2 Section 9. However, it only prohibits those that participate in a duel from holding public office rather than prohibiting the act itself.

I would never burn a flag. But as an American i can say it is definitely any Americans right to burn one if they feel the country is in such distress.

Many of these amendments would have literally contradicted other amendments.

If we aren't going to put term limits on the Senate I think we should bring back the dueling thing for 65+ members

The Treaties Amendment seems amazing. That one should definitely be brought back!

The Bricker Ammendment seemed so good as further limiting the powers of the government, not to an unreasonable degree, but in a way to prevent loopholes for overriding established domestic laws. Even if this hasn’t been the case, the constitution has worked due to its assumption that people cannot be trusted with power; therefore, checks and balances amongst branches with different functions make it difficult for bad actors to pass legislation in bad faith. That would just be another extension of such check in executive power

I would much prefer dueling over lawsuits

The hyper partisanship would likely extend to the delegates of the convention. The amount of delegates per state would likely rekindle the old Senate v House issue.
Finally, outside of term limits, I can't see anything being adopted by 3/4 of the states as all other ideas are mostly partisan.

Great work. You have a new subscriber! It seems your channel is focused on us political history. Another topic that might be interesting is failed secessionist movements in the US. From the State of Franklin to modern Alaskan, Hawaiian and Puerto Rico, the US has a lot of secessionist movements.
