***FAIR USE DISCLAIMER***

Copyright Disclaimer under section 107 of the Copyright Act 1976, allowance is made for “fair use” for purposes such as criticism, comment, news reporting, teaching, scholarship, education and research.

Fair use is a use permitted by copyright statute that might otherwise be infringing.

Non-profit, educational or personal use tips the balance in favor of fair use.

One of the rights accorded to the owner of copyright is the right to reproduce or to authorize others to reproduce the work in copies or phonorecords.  This right is subject to certain limitations found in sections 107 through 118 of the copyright law (title 17, U.S. Code).  One of the more important limitations is the doctrine of “fairn use”.  The doctrine of fair use has developed through a substantial number of court decisions over the years and has been codified in section 107 of the copyright law.

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research.  Section 107 also sets out in four factors to be considered in determining whether or not a particular use is fair:

1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes

2. The nature of the copyrighted work

3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole

4. The effect of the use upon the potential market for, or value of, the copyrighted work

The distinction between fair use and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission.

The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: “quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author’s observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.”

Copyright protects the particular way an author has expressed himself. It does not extend to any ideas, systems, or factual information conveyed in the work.

The safest course is always to get permission from the copyright owner before using copyrighted material. The Copyright Office cannot give this permission.

When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of fair use would clearly apply to the situation. The Copyright Office can neither determine if a certain use may be considered fair nor advise on possible copyright violations. If there is any doubt, it is advisable to consult an attorney.

“The funny thing is, on the outside I was an honest man. Straight as an arrow. I had to come to prison to be a crook.” — Andy Dufresne

I realized something while rewatching this. One of the motivations for Andy sending those letters and eventually building the library. He'd have access to the prison blueprints and know the layout of the entire place including its pipes.

Probably one of the best things in cinema history and all taught us a valuable lesson. There’s always light at the end of the tunnel but you may have to go through a ton of shit just to get to it

That was such a slick escape. Not only did an innocent man break free, he exposed the corrupt Warden and Chief of Security while stealing all the Warden's cash. A well deserved fate for all three of them. Red finally making parole and meeting up with Andy was great too.

Life lesson of the story: sometimes you gotta crawl thru shit to make your goals obtainable

I guess when Red said escaping was just a "shitty pipe dream" he meant literally?

For those talking about there possibly being iron bars are the end of the pipe, the book kind of addresses that. Andy devised his escape based on some prison blueprints he found, which I presume stated that the drain was open and not sealed by bars.

This movie is probably the best movie that i have seen in my lifetime. Not only an experience of a life time, it's themes and messages are extremely relevant and reassuring in real life. It teaches us that it does not matter how harsh, unfair, cruel, hard and terrible your life becomes, you must not leave hope because as Andy said "Hope is a good thing and no good thing ever dies"

Fun fact Morgan Freeman uses his sons picture for his prison picture in this movie.

The way he rips his shirt off is so perfect. That's decades of misjustice being removed right there.

In the german version he even had a longer way trough the pipe - 500 meters instead of 500 yards.

Andy should be thankful that the movie was shot in the United States so his escape was way easier

Andy locked up in Shawshank, and the most important years of his life — those years when it's time to live, to love, to work, to have children, — he has been in prison . It is unknown how that would affect the psyche of another person, but Andy remained in the mind and not lost the most important thing. Andy managed to keep his ability to fight, to go forward, despite two consecutive life terms, the ability to beat in a locked door, tear, gnaw, scrape nails, 20 years to batter the wall, but don't give up. This film is about human freedom, first and foremost." Fear makes you a prisoner. Hope gives you freedom." "The Shawshank Redemption " - a hymn to freedom is not physical, but internal. This film is like no other able to show the real values of life. It's really a great movie, deep and smart as a good book . A brilliant movie that gives strength and hope.
