Do NOT say "Yes" or "No" simply say "I do not consent to any searches!"

I remember being asked if they could search my vehicle only once. I asked if they had a warrant. They told me that they had "asked a yes or no question, can we search your vehicle." I told them that I had asked a yes or no question as well that hadn't been answered. "do you have a warrant." The answer was no. Despite their frustration at being told no by a 20 year old kid they had to let me go. People please take the time to read the Bill of Rights.

When i was about 21 the cops pulled me over. I legit didn’t have anything on me, so they asked to look around and I had no reason to worry, so agreed. About an hour later, they had ripped my back seats all up, completely tore my vehicle apart. Never ever again will I consent to a search, even when I don’t have anything to hide. Lesson learned.

I’ve had them stop me and claim that I didn’t come to a complete stop at a stop sign which they were lying about. Then the officer proceeds to tell me “you are going to step out of the car facing the car with your hands on your head”, blah, blah, blah, the whole song and dance they give you. Then he says “Before I search your vehicle do you have anything that you shouldn’t?” And searched my vehicle without asking me stating that they had probable cause because I was “acting nervous” I’m telling you they are all dirty and they always use the “acting nervous” to justify violating your rights and there is no way to prove something like that either way.

If a legal system is allowed to use tricks and loopholes in order to carry out what is otherwise an illegal act, that legal system needs to be overhauled. There shouldn't be any ambiguity in any law. When there is ambiguity, the less informed person loses and the more informed person manipulates the system.

My brother was stopped and they asked to search the vehicle. He said "I do not give consent, there is no reason to". They pressured him and even said they would bring a dog and he told them go ahead. Dog came and nothing. They still wanted to search the vehicle. They did. My brother dash cam recorded the whole conversation. He sued, police denied searching the vehicles. Lo and behold, their police bodycam was "corrupt" but he produced his own recording. It cost the department $200K. And they never gave a reason as to why he was pulled in the first place. His Dash cam saved him.

A cop once asked me if he could search my vehicle back in the 1990's. I said, "Not without a warrant." He said, "What are you afraid of if you've got nothing to hide?" I said, "I'm not afraid of anything, I'm offended that you think I'm the kind of scumbag who needs to be searched for whatever it is you're looking for." He let me go on my way shortly after that. I didn't have anything illegal & it would have been a huge waste of my time & his But, it was a matter of principle & I wasn't in any rush to get anywhere.

Right answer is always: "I do not consent to any searches." Never, ever get caught up in small talk with any cop.

What bothers me the most is that our law enforcement is attempting to "trick" citizens to search their vehicle. That right there is a big problem.

As a former police officer, this is absolutely solid advice. We are taught how to get a person to give up their constitutionally protected rights voluntarily. By using tactics like this. The follow up to this, once you deny consent, is to say, "If you're not guilty, you have nothing to hide." Another tactic is not to ask, "are you on parole or probation, " but to ask, "Who is your P.O.?" If someone is on parole or probation, and under the search and seizure requirements thereof, they'll almost always say who their P.O. is (thinking we already know) and that gives the police the permission they need to search a vehicle without consent. Another thing to touch on is the "plain view" rule that also gives exemption to permission or probable cause. If you have anything laying out in the open that can even be considered a weapon, drug paraphernalia, etc., an officer can search your car without consent. Rule #1 - never give consent and never answer questions not pertaining to the reason they stopped you. A lot of times the cops are on a fishing expedition and they're well-trained on how to get you to voluntarily give up your rights. The cops are NOT your friends. It's a big deal to an officer to turn a simple traffic stop into a felony arrest. So be very careful what you say! The best thing is to not say anything at all.

I'd really like to know why a legal procedure for asking for consent to search has never been established by a court decision. Surely, just as with Miranda warnings, an officer should be required to a) inform a subject that they have the right to refuse to consent to a search, and b) clearly and unambiguously ask them if they will waive this right.

Just subscribed. I will be 80 this summer (2024), and going on a long solo road trip-2600 miles total, covering three states. This is advice a driver can use in any state. As an older woman, I am very careful, and aware of my surroundings. But my generation still thinks of LE as being a friend to rely on. I would not have thought of this on my own. Thank you.

A retired police instructor told me that another trick is they will ask you to step out of the car before you give all of your paperwork. When asked for the remaining paperwork, you might say it's back in the glove box and you offer to get it. The police will not let you re enter your vehicle and they say that they will enter and retrieve it (presumably for their safety). This instructor told me to always ask if there is anything more (paperwork) that they will need before you exit, because you will be locking your car as you exit.
