Section 6. Retention Limits. — Except as otherwise provided in this Act, no person may own or retain, directly or indirectly, any public or private agricultural land, the size of which shall vary according to factors governing a viable family-size farm, such as commodity produced, terrain, infrastructure, and soil fertility as determined by the Presidential Agrarian Reform Council (PARC) created hereunder, but in no case shall retention by the landowner exceed five (5) hectares. Three (3) hectares may be awarded to each child of the landowner, subject to the following qualifications: (1) that he is at least fifteen (15) years of age; and (2) that he is actually tilling the land or directly managing the farm: provided, that landowners whose lands have been covered by Presidential Decree No. 27 shall be allowed to keep the areas originally retained by them thereunder: provided, further, that original homestead grantees or their direct compulsory heirs who still own the original homestead at the time of the approval of this Act shall retain the same areas as long as they continue to cultivate said homestead.

The right to choose the area to be retained, which shall be compact or contiguous, shall pertain to the landowner: provided, however, that in case the area selected for retention by the landowner is tenanted, the tenant shall have the option to choose whether to remain therein or be a beneficiary in the same or another agricultural land with similar or comparable features.n case the tenant chooses to remain in the retained area, he shall be considered a leaseholder and shall lose his right to be a beneficiary under this Act.n case the tenant chooses to be a beneficiary in another agricultural land, he loses his right as a leaseholder to the land retained by the landowner. The tenant must exercise this option within a period of one (1) year from the time the landowner manifests his choice of the area for retention.

In all cases, the security of tenure of the farmers or farmworkers on the land prior to the approval of this Act shall be respected.

Upon the effectivity of this Act, any sale, disposition, lease, management, contract or transfer of possession of private lands executed by the original landowner in violation of the Act shall be null and void: provided, however, that those executed prior to this Act shall be valid only when registered with the Register of Deeds within a period of three (3) months after the effectivity of this Act. Thereafter, all Registers of Deeds shall inform the Department of Agrarian Reform (DAR) within thirty (30) days of any transaction involving agricultural lands in excess of five (5) hectares.

I am planning to buy my mom's agricultural land. Sabi ng DAR, hindi daw pwede ibenta ang land kahit anak pa ang buyer. I just wanted to have a second opinion po. Gusto ko po sana kasi na may papel kaming mahawakan ng partner ko bago kami magtayo ng house kahit pa sabihing sa nanay ko galing ang lupa - cause you never know.

Nagpa sukat po owner ng lupa, palayan po, tpos meron po nahagip na mga palayan ng ibang nagsasaka, pano po ba yung proseso Atty. Para ma assume at ma trabaho na po ng tittled owner ng lupa na sinukat na my nahagip na ibang lupa na katabi.

Thanks sa info Attorney! kaya pala ung may-ari ng 30 hectare na lupa sa batangas nagkaroon ng exemption dun sa 5 hec Ceiling is dahil sa livestock ung agribusiness nya, now I see why 🤔

Sir, Yung lupa ng Lolo ko sinanla ng Uncle ko ng WW2, exluded yung mga paslit niyang kapatid na minor children nasa pangalan nila ang Titulo dahil na patay Lola namin at nasalin sa minor children ang lupain. Na foreclosed ito, w/ Section 4, Rule 74. Ngayon, di nag bayad ng real estate tax yung Company na bankcrupt, let it slide his redemption right. Ngayon, na public auction tax sale ito & the same minor children nakabili ng 1990 mga adults na sila noon. Na transfer sa kanila ulit yung Title of land & nabalik yung possession. Ngunit, yung Company na lugi ay ini offer nito sa DAR Voluntary Offer to Sell yung land na di na siya ang registered owner. Na CARP coverage ngayon Title nya na cancelled. Denemanda pa ng Co. dating may-ari nakabili sa Auction sale ng di nagbayad ng tax, nagkarun Pending Case. Yung DAR, nagkarun Operation Land Transfer, nag announced sa Community ng land sale. Pinasok ngayon ng Sangguniang Bayan & mga barangay Captains, Tanod, Kagawad & Councillor ang lupain namin, may no trespassing sign. Sinira bakuran. Demanda namin ng forcible entry cases. Hinuli cla ng pulis. Nag temporary rest - raining order yung MARO & PARO sa MTC removal of jurisdiction, leaving behind yung crimes, tinaga pa pinsan ko na transfer sa DARAB. While may Litis pendencia & yung Title ni represent ng DAR cancelled. After that, tsaka pa lang ng DAR ma realized VOS, void ab initio. Natapos ng Civil Case sa RTC & Court of Appeals at nag karoon ng final decision in favor samin. Hindi ma execute yung judgment ng CA dahil pending parin sa DAR yung VOS & it took custody of our lands in violation of due process of law mandated in our constitution that no life, liberty or property shall be taken without due process of law. Hangang ngayon nandoon parin yung case, dalawang decision ng mag lalaban dun Court of Appeals & DAR. Nasa portals parin ng DAR Court and now @ Office of the President yung lupain namin. Habang na quarry ng lupain namin kinuhanan ng bato dahil nasa mountains & uplands ito. Nakalbo ng mga puno ng manga & abokado at tinirhan ng mga informal settlers.

My grandmother and my auntie and my mother own a 210 hectares 28. Hectares is riceland cornland and cocoland and the rest are pastureland puedi po ba kmi ka apply for exemption sa pastureland ?

Ano po ang dapat kong gawin kung ang RD n nakakasakop s aming lupa ay walang record ng aming title. Since kami po ay may owrers copy.nagbabayad nman po kami ng amiliar. May tax clearance.pero ang recomendation ng rd ay mag file kami ng judicial reconstitution medyo magastos at matagal ang proseso tama po b ang rd sa dapat nming gawin?
