"Section 65. Conversion of Lands. — After the lapse of five (5) years from its award, when the land ceases to be economically feasible and sound for agricultural purposes, or the locality has become urbanized and the land will have a greater economic value for residential, commercial or industrial purposes, the DAR, upon application of the beneficiary or the landowner, with due notice to the affected parties, and subject to existing laws, may authorize the reclassification or conversion of the land and its disposition: provided, that the beneficiary shall have fully paid his obligation."

Lands that are Non-Negotiable for Conversion

1. Lands within protected areas under the NIPAS, including mossy and virgin forests, riverbanks, and swamp forests or marshlands, as determined by the DENR
2. All irrigated lands, as delineated by the DA and/or the NIA, where water is available to support rice and other crop production, and all irrigated lands where water is not available for rice and other crop production but within areas programmed for irrigation facility rehabilitation by the government;
3. All irrigable lands already covered by irrigation projects with firm funding commitments, as delineated by the DA and/or NIA; and
4. All agricultural lands with irrigation facilities.

Dito sa amin agriculture ang land pero napagpatayuan napo ng mga commercial building... dapat cguro fucos sa information drive ang mga taga DAR bago magpa penalty.

Hello po..tatanung ko lang po my nabli po akong lupa portion lang po..cloa po..ung kabuuan po nung lupa mhigit 4000sqm po .ginwa po ning mayari benenta po sa 24 katao ung lupa .. ng apply na po kame para sa Dar clearance kaso po d nakpsa sa ocular inspection.. Denied po apply namin kc po my mga bahay na po kameng nktayo dto..kong sa convertion po kaya kame papasa po kaya kame..sana po msagot po.. thank you po

Kailangan na po ba ng reclassification kung bahay kubo lang naman po ang nasa agri land? Yung bahay kubo po ay yung mga nabibili lang po at pwede naman po ilipat kung bawal po talaga.

Atty. May lupa Po kaming pinarerentahan sa Isang gasuline station 2020 ng mag simula Silang nagtayo ng gasuline station nila pero bago naman Sila mag simulang mag construction dumaan kami sa proseso tulad ng permit sa engineering office at pagbabayad ng buwis mula sa agricultural lot ay naging commercial lot na Ang binabayaran naming tax sa assesors office Ang lupa naming ay 15, 580 sqm. Pero Ang nirerentahan lamang ng gasuline station ay 3 thousand more or less pero itong taon na ito nagpadala ng sulat Ang DAR sa assesors office na Pina cocomply Ang gasuline station na umuupa dahil Hindi daw dumaan sa DAR approval ang pagpapatayo ng gasulinahan.tanging Ang kailangan mag comply daw sa DAR ay Ang gasulinahan dahil nag operate na at kaming may Ari ng lupa ay Hindi na kami dapat mag comply sa DAR. Ang tanong ko kung may pananagutan ba Ang assesors office sa Hindi pag Daan ng land conversation sa DAR? Ang assesors office Po Kasi Ang nag convert sa lupa namin mula agricultural lot to commercial. Ang lupa Po Pala na nirerentahan ng gasulinahan ay naka tiwangwang lang Hindi Po pwedeng taniman talagang pang residential lamang commercial use lang talaga Ang gamit at Wala pong irrigation na katabi Ang lupa namin.

Atty ask ko lang po yung lugar nmen 10+ hectares private owned xha pero may nacovered n po na CARP (CLOA) na 3+hectares noong 1990, at ung 8+ hectares po ay na reject dahil residential na since 1950 pa, ngaun po ung naiwan n 8+ hectares na residential ay binibenta sa mga nakatira (sa amen) at na reclassified na ng MARO at PARO nag zoning po sila noong 2018 lang, pwede pa po ba na ma covered ito ng CARP, naguguluhan po kz kame kung kanino kme maniniwala sa owner or sa farmers na nag aapply na ma cloa ang tintirahan nmen.

Hi Atty, ask ko lang po kumg pwedeng patituluhann ko ang aking isang lote pa na Commercial (180 sqm) po ang classification, kasi sangayon sa taga DENR ay hindi na pwede dahil mayroon na akong naunang isang residential na lote (160 sq. m ) na napatituluhan ko na sa kanila. Attorney pwede bang ipa concrete fence at tambakan ang agricultural land? Ang location nya sa likod ng mga residentials it is for securing purposes. Hindi na mabuhay ang pananim (Palay) dahil lubog na sa tubig.
