AFRICAN PRISONS FULL BECAUSE OF COLONIAL LAWS

Pre-colonial Africa had no written laws and no recognized incarceration or prison systems. African societies were communal and the Justice system was therefore restorative. Meanwhile the Western world were capitalist societies and their laws were meant to protect property and property rights, and therefore their justice system was retributive .
The "cut and paste" laws from the colonial powers onto african countries was the biggest blunder of the century .The colonial laws meant for oppression and tapping forced forced labor are now to be used to run a modern day state. This has made Prisons in Africa full .This raises serious jurisprudential issues.
