What does it take to win #socialsecuritydisabilitybenefits if you cannot work because of severe and chronic back pain?

In this #shorts video, I discuss what I have learned about winning #backpain cases in #socialsecurity hearings over the past 30 years.

#spinalpain is the most common reason that people file for disability, so Social Security makes it extremely hard to win these cases. Mild to moderate pain won't be enough. A disc bulge with no impact on the spinal cord or spinal nerves won't be enough.

But #MRI evidence of a #herniateddisc with cord impingement or nerve root impingement often will be enough to win, especially if you are age 50 or older #gridrules.

Recently applied, I have a few recent MRI’s showing disc herniations at l4, l5 and S1, lumbar radiculopathy, and X-rays that show a few things including multilevel disc degenerative disease. I got into a car accident that exacerbated my injuries terribly and I had to receive a spinal fusion months ago and I’m still in a tremendous amount of pain that shows no sign of letting up. I have tons of medical reports including my operation report

I have all of these plus complex regional pain syndrome and still being denied. Had to hire a lawyer and now I’m getting a zoom hearing with a judge .

i have ddd, severe stenosis, arthrosis, root nerve impingement and radiculopathy, i have severe depression ptsd, uncontrolled type 2 diabetes with neuropathy, confirmed by mri and emg testing, im on meds for all 3 of my impairments, i going for the grid rules, ill be 58 this year and worked 38 years total, but just hired a lawyer because i dont need a hard time getting the moneys i paid into ssi, but my back is bad!

I have everything you have mentioned and then some. I have provided the SSA with RFC reports from my doctor MRI's that my doctor said are some of the worst he has seen and i was denied the first time and am at step 3 of 5 of the reconsideration and they now have nerve conduction studies that show nerve damage and also my doctor just wrote them a letter stating i meet both musculoskeletal listings 1.15 and 1.16 without question. Do you think all of this will be denied again and i will have to see a judge? I feel like they have so much objective evidence and doctors records that a judge should be upset to have to even deal with the case and wonder why it wasn't approved and ended up on his desk. But of course I'm no lawyer.

Thanks for your videos. I've been watching and following your advice for a year and a half and gathering every single piece of evidence you have ever mentioned and slamming them with it. Now I'm just praying for the best.

I suffer from degenerative disc disease, sciatica, osteoarthritis, and spinal stenosis. I’m now walking with a cane and about to take epidurals.
I also suffer from torn ligaments on both ankles, and had my dominate had ( fingers) crushed during my time in service. Because of this my pink hangs, it makes it hard to grasp and I can’t lift heavy objects.

I've been watching your videos for years. I applied for SSDI back in 2019 went all the way to the administrative law judge stage and was denied November 2020. I had all the evidence that you mentioned and more but of course I was only 33 at the time.
I think it's bias of social security when it comes to age. Why is it that they think just because you're young that you will recover. They said there was a job I could do based on the vocational expert.

I applied again and was denied in April of this year and now have filed for reconsideration but of course I have other medical conditions that I have added since then. If the social security administration considers all other medical conditions then why are they only approving people based on just one?

Also I've been dealing with this back injury since 2015 and still have the same nerve pain symptoms down my leg. I had an orthopedic doctor back in 2019 say in a letter that he considers it permanent.

I've been out of work since August of 2018 so I believe I'm running out of work credits at this point.

I got my ssdi notice of award sent to me showing I was approved. Official decision approval date was January 24, 2023.  

Notice of award states "You are entitled to monthly disability benefits beginning December 2022.

Further, it states: "We found you became disabled under our rules on June 30, 2022."

My question is since I was officially approved in 2023 with a disability onset date in 2022, was I eligible for up to the 2023 max amount or was I eligible for up to the 2022 max? Thanks.

What about a chiropractor, who agreed to be audio recorded due to my lack of memory, refusing to adjust me after seeing his X-Rays which showed degenerative disc changes throughout the spine. Bone spur/arthritis throughout the neck and lower back, which is the only places that were x-rayed by him. When I bring up my lower back that has hurt my entire life to him as he’s rushing me out of his room he says “oh yeah that last vertebrae is pushed way back there pinching on that nerve. you know kids with slip and falls but I don’t know how you got it way back there.” I was told by the spine specialist I saw that there is nothing an x-ray would show that they wouldn’t be able to see in an MRI. Is that true?

I had these issues and evidence and was still denied even by alj . So debating on refilinh again due to being older now. Was 44 when filed now 48
