In Non-Bailable case : But if there are evidence while filing private complaint, then too magistrate will issue summons ? The summons is only for validation right ? So if the Magistrate is satisfied with evidence then there could be Bailable or Non-Bailable warrant ? If there's threat of tampering of evidence or anything so on this grounds is arrest warrant possible ? The summons are mandatory 1st step even in Non-Bailable cases ?
