My name is John Degasperis, I am a trial lawyer. My office is based out of Kingston, New York. I represent injured people. I probably represented more than 1500 injured clients over the course of my career. I understand how insurance companies work. I understand how the court system works and how to persuade juries.

Thank you for coming to my Youtube Channel. Please like and subscribe for my informative videos. If you have any legal question at all, personal injury or otherwise, please do not hesitate to contact me, I love helping people.

Most of my cases are handled within the Hudson Valley although I do handle cases all over the state and throughout the country. I pride myself on my availability and I live and I breathe this work. When a client hires me I become obsessed with their story. I become obsessed with their case. My singular objective is to do well by them and to put them into a better place than when I found them. I know that being a lawyer requires empathy. I am a sounding board for people in their darkest hours and I become their voice. I am their advocate within a system that may not have their best interest at heart. A successful resolution is when a personal injury client feels as if the system worked and that I brought them to a place in the Civil Justice System, that gave them an opportunity to be made whole again.

Like a good neighbor... State Farm says "take us to court"

Been there before. I got hit by their customer while I was on a motorcycle a few states away. Completely his fault and he admitted that. Flew home to have the surgery I needed. Talking to State Farm and they told me I had to have my bike moved from the mechanic it was at for an estimate to a junkyard or wherever. I said “your customer hit me, you’ve totaled it and accepted responsibility, and I’m 800 miles away and have surgery tomorrow.” State Farm adjuster literally doesn’t “doesn’t matter, it’s your responsibility”. Hung up with them and immediately called a lawyer. They ended up paying a lot more than they would have if they weren’t assholes.

So true. 30 years ago my pregnant wife was struck by another car, rear-end collision at a stop sign. We initially asked for a $5000 pain/suffering settlement from our other-driver uninsured motorist compensation. They balked, only want to pay us $1500, trying to say our medical expenses (we also paid for additional medical coverage) were covered, totaling more than the $5000 we asked for. So we balked, with our agent unwilling to help us. Hired an attorney, five years later, they had to pay a $50, 000 settlement, plus paid their own attorney fees over their five years. Crazy business model

I was a paralegal at a firm that represented some big insurance companies. They insisted on fighting payouts even after the attorneys told them they were in the wrong. They insisted on fighting all the way through trials after being told they were going to lose. Then they would lose huge. Insurance is a scam in all states.

There needs to be more public media about State Farms unethical practices.

Here’s a little story about Liberty Mutual. My father had the same car insurance policy with them for 49 years, yes 49 years. He had not so much as a fender bender in his life. 0 claims over the course of that 49 year policy. He buys a new Toyota truck for cash. Puts the highest level of full coverage insurance on it and adds it to his policy. About a year into owning it a 19 year old blows a stop sign at a side street and T-bones my dads truck drivers side. The truck isn’t totaled but the drivers door, the drivers passenger door are unopenable and the windows are shattered. The 19 year old driver was not licensed and had no insurance. So as one does my father made the claim to Liberty Mutual to get the truck repaired. After months of back and forth they only paid out 60% of the total repair bill of the lowest estimate. So it doesn’t matter how good a driver you are. Or how few claims you’ve made on your insurance or how long you’ve been a client in good standing. Insurance is a scam and these companies don’t give a crap about their clients. They cancelled his policy after the payout. They will screw you and tell you if you don’t like it, get F’d

I had to sue State Farm after they made me jump through hoops doing a bunch of medical stuff after their driver hit me. When they finally called my Mom claiming we didn't do any of it and weren't getting paid, we went to a lawyer.

My Mom had tracked EVERYTHING and our lawyer had a gisntbsmile on her face.

The opposing lawyer, desperately grasping at straws, used "Why didn't you take a different road?" To try and place blame on me?

A friend of mine had his Harley stolen. State farm accused him of stealing his own bike, taking parts off of it, dumping it, sent a private investigator after him, put a tracking device on his car, then tried to get him take his non running bike to a shady motorcycle shop known to be run by drug dealers and thieves to have an estimate done. He trailered his bike to a reputable shop instead. They let the bike sit at the shop for months, refused to pay for the storage fees, then tried to pay him half of what other motorcycles of the same make and model are selling for locally. Now tell me insurance isn't a scam.

The insurance industry motto is "Why should we pay just because we said we would?"

They get away with it because most people lack resources to fight them. Every single one of these insurance companies executives should be in prison

My dad sells insurance.
He hates state farm as well.
There was a state farm office next door to his office for 20 years.
He would regularly send customers over there so they could shop around.
He knew they would always come back. On the rare occasion state farm could beat his rates...the customer would be back in his office saying "you were right...they're a terrible company with terrible customer service."
The state farm agents understood and agreed.

That's why we started calling them "Snake Farm."

I had State Farm auto ins. I cancelled it after 6 months and got a cheaper rate at another Ins. Co.
Two years later they send me a bill for two years of insurance I didn't have with them. I went to court with one piece of paper. My receipt of cancellation for my auto policy. The judge was pissed.
This was the late 80's. They have not improved.

My daughter got rear ended by a State Farm customer. The adjuster said it was my daughters fault, but she would pay half. I took them to court and the kid that hit her said it was his fault. The amazing thing about this was the shocked expression on the State Farm representative when they lost. How could a rational person be shocked? Even the judge asked “Why are we here?”
When I initially went to my lawyer he quickly asked, “Was it State Farm?” The joke was on them, I gave the court the highest estimate which covered legal fees and a profit.

I canceled my policy with state farm and they kept billing me and sending me monthy reminders that they were going to take legal action if i didnt pay them even though the bill was paid off. I ignored it and they eventually gave up. If they went through all that trouble trying to squeeze an extra 80 out of me because i left i cant imagine the lengths they go through to not pay out

They do this in hopes that A) the person can't afford a lawyer B) they don't know how screwed they are getting so don't get a lawyer C) don't want to deal with the hassle of years and fold after a week. Government saying we need insurance, but doing nothing to stop known predatory practice of such companies are a scam.

Insurance is the weirdest thing. You’re their client and best friend until you actually file a claim, and then your relationship turns adversarial and you have to fight for every penny.

It’s not only them, all insurance companies do this stuff. We pay them thousands a year and then when we need to get paid they refuse to do it

Last time I was in a car accident we were rear ended by a person who had State Farm. They were horrific to deal with. I had just had a steroid shot and the adrenal rush just depleted the efficacy of the shot and the dr decided that I needed a shot into my spine of steroids as well, to stop spasms. A four inch needle into my spine. The insurance company offered me 200 dollars, noped right out of that. In my state the insurance company doesn't have to settle for two years, they literally wait for a person to become desperate enough to settle for a much smaller amount. I had time and secondary insurance, all the time in the world. I waited them out and got a much fairer settlement. Took about 16 months but it was good
