The Xbox Activision Deal is Dead if the FTC Keeps Blocking

Microsoft has made a comment in official court filings about the Microsoft Activision deal and how it could be dead if the FTC Block continues. The FTC has filed an injunction against the merger meaning that the FTC has made Xbox Activision Blocked the main headline in the US. The Microsoft Activision Deal Blocked by the FTC would mean that they never even had to make a strong argument against the merger, but instead tied it up for so long that Microsoft was left with no other choice but to cancel the merger.

The problem with this is it sets a precedent that the ftc will just stop anything they want by tying it up in court indefinitely instead of by legal means

A Judge has to be able to see through this, and reject the FTC’s baseless attempts to block. Prove it or fuck off FTC. That’s what I would be saying if I was a judge.

This was a temporary injunction to keep the deal from being consummated by the date in the agreement. This was a play to get the FTC in a federal court. The federal court is a much better setting. Microsoft and ABK wanted this to happen as it accelerated the legal process.

I know it's probably a good thing regulators don't seem to have bias towards companies from thier country (u wouldn't want Japanese regulators with a sony bias) but I still find it odd it's the ftc that's the biggest obstacles for Microsoft. And yes I know Microsoft is a global company but it's still an American brand. You would think China and Japan would be Microsofts biggest obstacle on a deal like this. Or at least in my limited understanding of it lol

Microsoft and ABK wanted it to go to District Court though. This gives them the opportunity to let them fight it out away from the FTC’s home court advantage. It speeds up the process and seemingly gives them a more even playing field.
