Defense Attorney Asks Me During Trial "Can I Use Your Trial Exhibit to Question Your Witness?"

This happens in practically every single trial involving medical malpractice, accident cases and wrongful death cases here in New York.

Each lawyer creates exhibits for the purposes of showing their evidence to the jury. Many exhibits are enlargements that are placed on poster board so that the jury can see exactly what the witness is talking about from far away.

Some exhibits are anatomical models and some are on a laptop attached to a projection. Most exhibits are very costly to prepare.

It truly is an awkward situation when the defense attorney gets up to cross examine my own witness and he turns to me in front of the jury and asks "Mr. Oginski, do you mind if I use your exhibit to question your witness?"

Likewise, there are times when I will turn to my adversary and ask if it's okay if I can use his exhibit so I can question his witness.
