Ensure compliance with Right to Work checks as an employer in the UK with our comprehensive video guide. With potential penalties and legal troubles at stake, it's crucial to understand the correct procedures and stay up to date with the latest regulations.

With over 14 years of experience in immigration compliance, our trusted law firm has helped numerous UK business owners navigate the complexities of Right to Work checks. In this video, we share our expertise and provide essential guidance to save you from hefty fines and potential damage to your business.

Non-compliance with Right to Work checks can have severe consequences, including civil penalties of up to £20,000 per breach, criminal prosecution, enforced debt action, and even suspension or revocation of your Sponsor Licence. Our goal is to empower you with the knowledge and tools to avoid these pitfalls.

We cover the three main types of Right to Work checks: Manual, Digital, and Online. Each method has its own benefits and requirements, and we delve into them one by one to provide a comprehensive understanding.

For Manual checks, we explain the step-by-step process of obtaining, checking, and copying original documents while ensuring compliance with data protection laws. We emphasize the importance of authenticity and record-keeping for the duration of employment and two years after termination.

Digital checks offer convenience and speed, utilizing Identity Document Validation Technology (IDVT) for remote verification. We highlight the necessity of retaining copies of IDVT check outputs in a secure, uneditable format to meet compliance requirements.

Online checks through the Home Office's online system are suitable for individuals with biometric residence permits, biometric residence cards, or settled status under the EU Settlement Scheme. We guide you through the process of obtaining and retaining the necessary documentation.

In cases where the above methods are not applicable, we introduce the Employer Checking Service (ECS). This free online service provided by the Home Office allows employers to fulfill their duty of conducting Right to Work checks in exceptional circumstances.

We address the recent changes regarding EU, EEA, and Swiss employees, emphasizing the need for valid pre-settled status, settled status, or a valid visa. For existing EU employees who underwent compliance checks before June 30th, 2021, retrospective checks are not necessary.

To support you further, we offer training programs for your Human Resources department and management team, equipping them with the knowledge and tools required to meet statutory duties and maintain compliance with Right to Work checks. Additionally, if you have or are applying for a Sponsor Licence, we can assist you in establishing compliance with sponsorship duties.
