What to Expect After You WIN Social Security Disability
Показать описание
As I discuss in this video, as a general rule you should see a deposit into your bank account within 4 to 6 weeks after you receive a favorable decision from the judge, or a notice of approval from Social Security.
However, there are circumstances that can cause a delay in this timeframe.
Perhaps the most common complication involves cases where a claimant has filed for both SSDI and SSI. SSI, as you may know, is a “means tested” program that is only available to claimants who have very limited assets and very limited to no household income.
If your case includes an SSI claim the SSI payment center has to conduct an “income and resource” interview to determine whether you qualify for SSI. You should appear at this interview and provide SSA needed documents even if you know that you do not qualify for SSI because of income and resources.
Your SSDI payment almost always offsets SSI but Social Security still has to go through the calculations.
Another complication and delay can arise if you were receiving workers’ compensation benefits for any months in which you were eligible for SSDI. Workers’ compensation offsets SSDI.
A third possible complication can simply be government red tape. SSA may want to see original documents to verify your immigration status, or a name change. If you have children eligible for auxiliary benefits, you may need to file a formal application for those benefits.
Usually SSA will tell you why there is a delay but sometimes files get stuck on someone’s desk and nothing happens until you raise concerns.
In more extreme cases we may have to involve your U.S. Senator or Member of Congress to help.
The bottom line is that you should receive a “Notice of Award” within one to two weeks after your approval and you should see funds within four to six weeks after your approval.
