Debt collectors can be very aggressive about getting you to pay the debt, simply because it's possible they won't get their debts settled if there isn't enough money in the estate, but that's not your problem; it's their problem.

Debt will not automatically be inherited. Dont buckle under the collectors pressure.

In short, the administrator of the estate checks if there are enough assets to pay for all the debts. If yes, the remaining money is split according to the deceased's will. If not, the assets are split between the debtors according to a variety of factors, and the rest of the debt disappear.

When my father past I got a lot of calls about his debt. I flat out told them he is deceased and good luck with getting the money. They just asked for a copy of his death certificate and the calls stopped.

Had this happen with the phone company after my Mom passed. They were getting aggressive and threatening. This was my response: "Sir, when my Mother died she had $5.01 in her checking account that was held jointly with my brother. By Rights of Survivorship that money belongs to him. However, I am willing to get you and all of her other creditors together, place $5.01 out of my own pocket on a table, and watch the lot of you fight over it sheerly for the entertainment value." They never called me again.

If anyone ever calls you saying you owe money, the quick and easy answer "who are you calling on behalf of" or "who are you collecting for." I keep a running record of anyone I owe money to in paper (can't be easily hacked) and I cross-check them. If the person they're claiming to represent isn't on the list, I tell them I need more information. Or, if its something I recognize but don't actually owe, I tell them I'll take care of it. For instance, a few years ago I got a call and they were collecting for a hospital bill my insurance should have covered. So I got on the horn with my insurance and fixed it.

Never, NEVER pay over the phone. If they're putting the crunch on you and saying you *have* to pay *RIGHT NOW OR ELSE*, odds are its a scam. Usually you'll have plenty of time when you first hear about a collector.

Don't forget to say that a judge has to approve it first. We had some "mystery" creditors disappear when they heard about the judge

Guys, the debts are paid with whatever the deceased had left. Usually the estate liquidates the assets (turns them into money) and pays all debts. If there is still money left, the heirs get it. If not, the rest of the debt dies with the person.

Most of those callers are scammers who saw the obituary.

Was pressured by a relative claiming my dad owed them 3000$. They kept lighting me up, saying a father’s debt is always inherited by his kin. I asked for proof of loan, and they immediately stopped contacting me lol

My father died a couple of months after his gf died, who in turn had died a few months after her brother died. Long story short, due to the chain of heirs, the IRS wanted to make me responsible for filling out the tax forms of the brother, a guy I didn't even know had existed. They hounded me for avyear and i only got out of it by repeatedly saying i could not deposit signed forms 'without reservation ' as the law requires

My mother died without a will in Maryland. We had to open an estate. We referred all debtors to our attorney. Several companies waived her debts either by company policy or because they liked her. Only one company waited almost six months until after the was settled. We told them tough luck you were given the information and did nothing. The money is gone.

My favorite thing about your content is how straight forward you are.

Before you even explain it you start off with 'no you don't" which is the most important piece of information.


My wife's grandmother fell for a reverse mortgage thing and she died like a year later and the place was pissed and kept trying to tell her family they owed the money.

They went from her dad to her mom to her older brother to her to me (that didn't last long) to her younger brother and so on until they tried to contact her 6 year old niece

It took them a bit but they gave tf up

When my mom passed away in 2021, an issue similar to this ripped apart the relationship between my two siblings and myself. Before we even had the funeral, my brother told me that I needed to give him money to help pay off some outstanding debts that our mom had. Meanwhile, he claimed all monies in her account and her vehicle. I told him that does not sound right and refused to pay him anything. I looked it up and was correct. He and my sister began to fight over my moms car and remaining possessions. After the funeral, I stepped away from both of them. I just wanted to put my mom to rest and grieve her passing. We still don't speak.

Mom passed but had no assets. When I got those calls, I laughed at them hard, then told them to piss off and hung up. Never heard from them again. 😂

Its very important to know that if the estate doesnt cover it all **the debt collector simply doesn’t get paid**

I worked at a law office for a year. It sucked because it was literally just me and a lawyer, but I'm happy to say that I can walk someone the basic steps of opening and managing an estate in my home state!

As executor, I got calls from people claiming that my mother owed them money several months after the period of notification to debtors had passed!! Tough luck -- you were not on the list & my mother's estate publically opened & closed that time period already, with the help of her lawyer...

Super easy concept... Did you essentially sign a contract or agreement with the company that is calling? No? ..Then not your fuckin problem... Go sue Granny in her grave and get the money outta her! I didnt sign any agreement with you, so it's not on me.
