The plaintiff hired the defendant to cater her daughter's birthday. However, they ran out of food during the party, so the plaintiff is suing for a refund. The defendant says the plaintiff wasn't sure how many people were going to show up. He does not believe that's his problem.

So for those who don’t understand the caterer should have wrote 203 with the additional amount of money it would cost to feed them along with a due date for the additional payment. He lost because he was too lazy to write in the complete modification of the contract.

She admitted that she didn't tell him it would actually be 200 ppl until the night before. If she had rsvp confirmed way ahead of time then why the night before telling him. I so believe she wasn't sure and was scared to pay for guest that wouldn't show. There is 2 sides and the truth somewhere in between
