If you are the victim of an injury from an automobile wreck or other incident, an insurance company representing the person at fault may contact you to offer a settlement. If you feel the insurance offer doesn't compensate you fairly, then your next step is to contact an attorney who will meet with you, listen to the facts of the case, and explain all of your legal options. The decision about whether to file a lawsuit is a complex, and a large number of factors must be considered. For example, an attorney needs to look at:
~ the costs involved in filing suit
~ the expected length of time needed to complete the lawsuit
~ the strengths and weaknesses of your individual case
~ the likely range of verdicts from the jury
~ the risks involved, such as a jury awarding less than the insurance company has offered
~ the available insurance coverage for the at-fault party
Most North Carolina personal injury cases must be filed in the county where either the plaintiff or the defendant resided, and a good attorney will assess the pros and cons of filing in each of the possible counties. If the case involves people who are from states other than North Carolina, then we may also be able to consider filing suit in federal court. It is important to consider all of the possible venues for where suit could be filed, and to make the best location decision given all the factors of each case.
