He says "obviously I can smell an overwhelming scent of alcohol coming from your vehicle", then ends up breathalyzing the guy and twice it comes back as 0.00. He then takes him to get blood-tested and, again, 0.00. WHAT DID HE "OBVIOUSLY" SMELL???

Also, if that's a "Terry Stop" pat-down, he does NOT have the right to go into OR remove anything from the pockets of the person; if the person is under arrest for failing to submit to a field sobriety test, and being transported to the station for a blood test, why is he being searched instead of just a pat-down?

You can smell alcohol, and arrest someone, charge them with a DUI, and they are completely sober and innocent!?!? WTF is this supposed to be about?? Making people pay out of pocket for towing, bail, an attorney, and possibly lose their jobs and the officers have immunity to prevent them from being sued for false arrest, incorrectly conducting a traffic stop, and these people will never see any of the money spent get returned! Tell me why qualified immunity is a good thing!?!? It just makes police departments WORSE than before!

In Arizona, our top DUI cop was just arrested for DUI.

Proof that smell should not be allowed in court because it can't be proven. He smelled "overwhelming odor of alcohol" coming from the vehicle and claims that he sees all these other signs of alcohol impairment and yet there's zero alcohol in its system. So the officer immediately changes up his story to the driver must be on some other drugs... But what happened to the overwhelming odor of alcohol?
