Although anything can happen, this Nov25 hearing is supposed to be about the Habeas Corpus whereby a judge can set aside a verdict on the basis of new evidence of letter and Roy and/or the excluded SA evidence excluded from the second rigged trial. The judge has only to satisfy himself that this new evidence and/or excluded SA evidence would likely result in a different verdict. Already jurors from second rigged trial have said that they would have voted differently had they known this excluded SA evidence.

If the verdict is set aside then the DA office has to decide EITHER to set up a new trial ( unlikely ) or legally they will have to set them free.. Habeas corpus literally means holding someone illegally. If they do get freedom this way then it actually bypasses the new DA and governor. But more likely the judge will reserve his decision and consult with Dec11 judge and new DA to co-ordinate their approach. Hang on to your hats folks. Anything can happrn

Housekeeping in anticipation of their release, which SHOULD HAVE HAPPENED BEFORE CHRISTMAS! What's the matter with this Judge? Can't he see that these elderly aunts aren't getting any younger? As soon as the sisters of both Jose and Kitty Melendez implored him to release the brothers, the Judge should have SLAMMED the gavel down, said "Happy Thanksgiving and Merry Christmas - Eric and Lyle Melendez, you are FREE to GO!"
