Menendez brothers Monday court hearing: What to know | LiveNOW from FOX

The Menendez brothers' case reaches an important milestone on Monday.

That's when the attorneys for Erik and Lyle Menendez will ask a judge to reconsider the convictions of the brothers, who are serving life sentences without parole for the 1989 murders of their parents, Jose and Kitty Menendez, in Beverly Hills.

The Menendez brothers are expected to attend the hearing virtually from San Diego where they are incarcerated.

The highly-anticipated court hearing will allow limited public attendance, with just 16 courtroom seats available through a lottery. The lottery will be held outside the Van Nuys courthouse Monday morning.

Monday’s status hearing is expected to confirm details for the resentencing hearing scheduled for December 11.

This comes after California Gov. Gavin Newsom declined to grant the brothers clemency, which was being considered as one route to the pair's freedom. Newsom deferred the review of the case to newly-elected DA Nathan Hochman, who is being sworn in on Dec. 2.

Defense attorney Mark Geragos says he will ask the judge during the hearing to re-sentence the Menendez brothers on the lesser charge of voluntary manslaughter, a crime for which they have already served three times the maximum sentence.

The final decision would come down to the parole board for approval.

Proceedings are scheduled to begin at 10:30 a.m.

If the Menendez brothers were indeed sexually abused as claimed, and their mother knew yet did nothing, the resulting rage and hatred would be unimaginable. Such profound betrayal, coupled with the trauma of abuse, could lead to an intensely volatile emotional state. While this doesn’t justify their actions, it’s possible that being pushed to such an extreme breaking point contributed to their violent response.I believe times been served. Let them be free.

Did you two even mention that the judge in the second trial wouldn't allow all of the abuse claims into the trial.
I would also like to know if your fathers repeatedly did this to you as a child? If you don't have that experience, then maybe bring someone in who can speak to that.
It seems unfair to use your bias as a basis for their release.
You also neglected to talk about what they have done in prison.

I think they just snapped. And the spending spree. They were young, and from what I’ve read, they didn’t have much freedom. Jose chose everything they had. I again think they just snapped and thought we can now choose what we want. I know when I was that age, I’d spend almost my entire paycheck on clothes, shoes etc. Now at my age, that stuff isn’t as important as saving money.
They’ve done enough time. They’ve been punished. FREE THEM
