I must say this a million times. If you want to sue for emotional damage, either A. The defendant needs to act so abnormal in court that the judge sees why you’re suing for that (which is extremely unlikely to happen) or B. Someone (a therapist, psychiatrist, psychologist, etc.) needs to give you a bill and a note saying that the treatment provided was as a direct result of the defendant’s actions.

For example, I see a therapist about once every two weeks, and a psychiatrist about once every month (both for my anxiety). If I go to court, I can’t sue someone for my copays, medications, etc because those were already in place. HOWEVER, let’s say that someone’s actions make me so distraught that I need additional sessions with my therapist or to up my medication with my psychiatrist, they could write an affidavit stating that these changes were because of this, provide an invoice for the additional expenses incurred, and then I could sue for those. But that’s maybe going to only be a few hundred dollars tops. All of these cases where people try suing for $1, 000.00+ just because “I felt bad” are ridiculous and no judge wants to deal with someone whining that their life isn’t perfect.
