My last landlord tried to keep the entirety of my $1, 000 deposit for "cleaning and repairs". Sued them and got back $3K. In my state if you wrongfully withhold the deposit, you can sue for treble damages. People need to start doing that, landlords always grossly overcharged for everything under the sun, and have no problem blatantly lying about things being done that in fact, were not done.

I don't know about this ruling. If the bill is itemized and the plaintiff is only suing for the pet cleaning portion because the defendant was the only one who had pets then its only fair that the defendant pays for that portion since they were her pets. The defendant should have also cleaned what the cats did before she moved out.

JJ may have ruled in this favor bc the plaintiff did not give the defendant the opportunity to query the charges by the landlord of the pet damages because she wasn't at the walk through. Who knows if the other roommates told the landlord some of the damages were caused by the cats when in fact it wasn't.

If the others did not have any pets, I believe the sole responsibility should have been on the defendant for the pet treatment and cleaning.

No JJ is right. How is she supposed to know the damage was from the cats and not from the roommates spilling stuff on the carpet? She should've been given an opportunity to see how much of the damage was attributed to the cats

Another ridiculous case - Why should they be responsible for a dollar of pet damage when she was the only one WITH a pet. Has JJ totally lost the plot? It was clearly itemised and the defendant should have been responsible for that. Crazy world.

I love that in Australia there is a Bond (security deposit) Registry that holds the funds.
At the end of the lease both the tenant and landlord comes to an agreement and the funds are then released. If neither side agrees, then no one gets the money and it goes to tribunal.

I hate when people know they don't have the evidence but just go ahead and show JJ some bs anyway. The plaintiff knew she never text the defendant to let her know when the walk through would be so why did she insist on handing that paper in.

There were THREE people in that apartment.
If this damage was ALL down to the cat, are we honestly saying that the other two just sat there for the whole time that they rented together, watching the cat damaging it .. and they did nothing to stop it because ''It's not my cat'' ?

The fact this woman was the only tenet with pets and the majority of the cleaning bill was related to pet damages I feel it was unfair to make the other 2 roommates pay for the irresponsible pet owner. Moral of the story, never live with a roommate with pets if you don’t also have pets.

One of the best defendants. Dressed appropriately for court and everything. She was lucky to get away with the hand being up, but she did a good job of looking scared while she did it lol.
