Too many Landlords are satisfied with what happens in the Justice Court after an Eviction trial. If they win and the Tenant leaves, the Landlord is happy with that. BUT what happens to the judgment if the Tenant appeals the Judgment of the Justice of the Peace and then moves off the property?

We had first eviction court case in September and my tenant asked for additional time to get a lawyer. Judge gave 45 days. Next case is pretrial in Nov 9 and trial Nov 15. It's crazy that the tenant can appeal in Nov 15th and continue to drag this on and not pay rent since AUGUST! From the looks of this if he appeals, this will continue on until January!
And yet I am paying mortgage every month. How is this theft even legal??!!!

Nassau County, NY- 9-2022 Landlord got Judgement with Possession, with warrant, No Stay/Issuance Forthwith, No Execution Stay, Earliest Execution Date 10/7/2022. Landlord ghosting residents on block now after approaching us with this information. No rent paid for 5 years. 120, 000.00 owed. I have talked to the sheriffs office and they have no paperwork for the property. And the 2 local attorney's I talked to said they should have been out already. The cases they worked on had tenants removed in 2 months (from October 2022). We are trying to figure out what is going on. The landlord said he didn't back any deals with them. We have not seen the sheriffs office there to serve them. And the tenant didn't show up to court that day. She lied and said she was out of town. When I went back to check the status in e-courts, everything was gone. What can that mean.

My tennant appealed the eviction decision by the judge. The tenant is 3mo behind, ($2600) and is just squating. In the appeal it says she has filed an affidavit for indigenous unable to pay. In the letter i got it says the court will just accept it as fact if not challenged in 5 days. Am I double screwed? can I go to the justice court and challenge that "paupers invoking" to not pay the appeal perfection???

I know you take care of landlords, but can I ask you something?

I live in Harris County, Texas. I am a tenant. I am perfecting my eviction appeal in the JP court.

If I move out before the next court date (and I inform the landlord that I have moved out) will I still have an eviction on my record *at the court house* ? I already know my credit might be screwed.

Side Note: I am not a squatter or a dead beat. I got evicted for being 10 days late with my rent. *10 DAYS LATE.* And I have *never* been evicted before and I have been renting apartments since 1993. And I'm not a bad tenant either. I never make noise or cause any other problems on the property. They want me out, so they can upgrade the apartment and lease it at a higher rate. They're just using this as an excuse to throw me out before my lease ends.
