“CAN YOU REFUSE A FIELD SOBRIETY TEST?” A question I get often. Here is a California Attorney Bruce Margolin’s answer.. I hope to put out 4-5 of these a week every evening with questions I get asked on a regular basis. I’m going around getting the questions answered by the most experienced and trusted attorneys, experts, and people I know regarding the specific question. You are NOT required to give a blood sample unless the police obtain a warrant. (per Birchfield vs North Dakota 2016)  However you are required to provide a breath sample AFTER you have been arrested.  Additionally, you are required to perform a pre arrest breathalyzer if you are under age 21 yrs old or you are on DUI probation.

You don't even have to take a blood or urine test....malke them get a warrant. lose your license? Not necessary. Your lawyer can argue. Main thing, don't answer questions or give consent, demand a lawyer be present for all questioning and don't do anything till your lawyer says to do it.

Don't take or do any test do not speak to them. Remain silent. I want an attorney. License suspension is a joke and you contest it not be facing jail and fines.

Yes, keep up advising these drunk drivers how to skirt the law and you too can experience the grief of losing a family member to a DUI!!!!

Wrong..just the opposite. Can't demand a blood or urine test by law but breath test, yes.
